The real problem will come if Thomas can figure out how to get the Tenth Amendment back into constitutional thought in a serious way.  The Second Amendment was a constitutional landmine for the left; the Tenth is a nuclear bomb.
Damnit, FDD!

We pretty much already got the 2nd Amendment back by stealth!  Now your going to wake the bastards up that we are on target for the 10th!

"Revisionist" could be misinterpreted without the context of Toobin's left leaning ideology. "Reassesment" would have been a better way to describe Toobin's take.

Possibly, but I think Toobin is attempting to be preemptive rather than actually thinking that there is major risk. I wouldnt be surprised to see the attacks on CT escalate.

If Thomas did something more than sit there with his eyes shut (he's not said anything for what, 5 years now?) I'd give him more credibility.

Probably both... Thomas is starting to get serious peer review, peer review outside the political realm, and it is impressively positive... the useful idiots and the bullet point readers do not know what to make of it

I did read it.

So maybe you can explain this to me.

I was taught judges were to be fair and impartial.

From the New Yorker:

You haven't "explained" bupkis. All you've done is toss out a couple of remarks accompanied by one-line quotations as if you deemed that sufficient for us to draw the connection. Toobin's article and the bloggers interpretation of it are odd. The fact is the present courts rulings have little if anything to do with Thomas. He writes few opinions and asks no questions. He usually concurs with whatever Scalia writes (including some dissents where the court goes 7-2 the other way). What the court is experiencing right now is the unfortunate issue with Anthony Kennedy liking being the swing vote. Kennedy's view on the scope of the commerce clause will be what decides the SCOTUS on the ACA not anything to do with Thomas, who has never really staked out novel ground on the issue rather he has swung back and forth in a very partisan manner in his opinions on the commerce clause.
