They convicted her of defamation, so that monster that has been convicted and jailed for abuse of power, may not have much to go on in charging her again. I think the jury and judge, from what is being said, covered the bases and her and her former boyfriends ass. By convicting her on this, which seems to be the only thing he could come after her for, she could be done.

She needs that passport and to get out of the country.

They could take it to a higher court... but by then, fuck them... she should be out of the country and here safe and let our government fight extradition back for more charges. The court said today that the evidence didn't hold up... hopefully these young people are free forevermore. There will be a huge protest if they aren't.

Italy needs to once again convict the monster with his accusations of demonic practices and a sex party that brought this murder on and an abuse of power. He has been convicted before for abuse of power and why he was again allowed power over peoples lives is a crime!

(Just my take on what has been in the media all this time.)

So, in Italy, can the prosecutor appeal the acquittal?

If so and If I were her, I'd be getting the hell out of dodge.

This article says the prosecutor can appeal.

She just left the jail and is free! Run Amanda, Run! I just wish they would report something on her former boyfriend. It wasn't just Amanda that went through this hell.

They were both appealing together and both convictions were overturned. The prosecution still has the right to take this to the Supreme Court. I'm not sure if they have to put themselves back under their jurisdiction though or not (once they go to U.S.A.) (don't remember if he's American or not, actually)

Not sure how much of a fight it would be considering with do have an extradition treaty with Italy.

We do, taz but due to the fact that the Italian court would be asking us to help them enforce "double Jeopardy" which is against the US constitution and law, would we extradite her?

ETA the answer to that is WAY to hell above My pay grade.

Then she should go someplace WITHOUT an extradition treaty with Italy.  Now that she is free, she should do whatever she can to stay that way.

Innocence or guilt is a legal decision.  The court has said she was not guilty, or at least that there is not sufficient evidence to have convicted her.  So, if the prosecutor's case failed, she is under no obligation to wait around to see if they can take another shot at it.  The system is the system. 
Had the court wanted to, I suppose they could have enjoined her from leaving the country pending appeal.  But they didn't..

I was reading more about this appeal, and the Italian system is very different.  They appeal is before an 8 person jury.  So, obviously the jury was convinced she was innocent.  The judge obviously did too, since there were all kinds of things he could have done to keep her in the country, like increase her sentence for the defamation claim until the prosecutors had time to appeal.  Plus,. The Italian government is probably thrilled the whole sordid mess is over.  So, I think Amanda will be in Seattle by tomorrow evening, and won't have to worry about being extradited.

Yea, but she wasn't found "not guilty," rather the courts decided the evidence was insufficient/tampered with and they shouldn't have been able to try the case, wasn't it? I think that makes a difference in Italian law and double jeopardy wouldn't apply like it does here.

I remember reading something recently about that. I haven't been feeling well or sleeping, so I really can't remember exactly what I read. I would think that given the fact it was determined the evidence was all messed up (tampered with, chain of custody, etc.), any new trial, a new defense attorney would likely be able to get that evidence excluded, and without all the messed up, tampered with evidence, they really didn't have a case.

Anyway, the poor girl is finally going to be able to come home to her family. I'm trying to plan a trip to Europe in the Spring and this kind of stuff makes me paranoid of traveling to Italy, which is one of the places I wanted to go (being Italian and all).

I wouldn't let this stop you, Italy is great. Well worth going to.
I imagine Amanda will be back in Seattle by tomorrow, and probably looking for an agent to sell her story.

This seem to me to be a vindication of a legal system that requires an impeccable level of evidence. I'm sure that cynics will make the point that she "got off on a technicality", but innocent or guilty she shouldn't be in jail unless there's no reasonable doubt as to her guilt.

Spare a thought though. for the Kercher family, to have lost a daughter in those circumstances....

This case has been dominated by tabloid attention. The 'poor girl' is variously described as a toxic personality who started lying immediately, accusing others. She is also reported to have a short fuse, becoming enraged and even violent when not getting her own way. A nasty drug user.
None of that makes her guilty of murder. From mainly American sources she is described as a wonderful person, gentle and caring.
Some of these comments are from people who knew her when she was a child.
The expensive (American) lawyers have attacked the evidence at a technical level, saying some tests were made too late and with too low a DNA count.
Opinion in Italy is predominantly that she has been got off in a similar way to OJ Simpson, being in this case white, rich and attractive. She has become a figure of hate.
In Britain, the Kercher family have maintained as neutral and dignified a position as possible. They now wonder if their daughter will ever have justice.
The 'monster' is black, another side issue.
If as alleged, the murder could not have been committed by him alone, why hasn't he been interviewed? Promise him an ocean view a la Hannibal Lecter for definitive information.
If he simply stated that he were the sole perp, the Kerchers might find some semblance of closure and therefore peace.
Knox is reported to have written her version of the affair. No doubt it will be a movie.
Will she be portrayed as a flawed innocent, a villain, heroine or some combination?
That might depend on where the movie is made, the U.S, Italy or UK.
