I'm sorry jack, but the only person ranting here is you.
And you actually did kind of elect yourself to be some kind of authority on what is real. So how come you can't take being called on your mistake like a man?
THE FACTS are simple Zuccotti Park aka Liberty Plaza is in fact owned by a private conservatory and THEY have given permission and on NUMEROUS OCCASIONS refused to sign various evisction complaints. The City of New York is using highly creative law and mayoral edicts to have a 'writ' to even enforce. Since the land is essentially still private land, and the city is relying on a thin at best agreement to partner in the park's maintenance as a basis for eviction, never mind a whole list of personal property, and civil rights violations, is far into the WRONG column when it comes the abidance with the law.
What the protesters did was take the eviction matter (which is only the first matter the city will be hauled into court on), into the appropriate jurisdiction. When you wish to remedy a faulty eviction in MOST states, the first stop is the land court.
You can't INVENT JURISDICTION buddy ... THAT'S THE REAL WORLD you speak of. Maybe you ought to join it.

MB... You in Manhattan?
Been out and about today yet? What's the mood in general like?
Any effect on the general population's everyday dialogue?

I'm in NC until Sunday.  My friends keep sending me messages.   There is a group of us that cycle through between working. The early morning crew and the current crew just say that everyone is even more motivated now.  The media seems the most upset at their own being kept in the dark and arrested.

Hey Skipper... any updates on the Berkeley nonsense?

They had one hell of a gathering in Ogawa again last night... And apparently people stayed, but I don't really know how many, cause @ 3am all live feeds started showing various views of OWS in NYC.
Portland had it's biggest GA ever for like over 6 hours. The kid with the broken back the cops dragged around till he lost consciousness was back and gave a speech.
I will talk to my buddy in Oakland and get some kind of update.
He did say that the Occupocalypse dance the other night got pretty wild in a very warm and humorous way. He said there porbably wasn't one Oakland cop who didn't go home with a smile on his face[:D]

Im a bit confused. The Judge in NY is a Supreme Court Judge from the accounts I am reading. Why would Bloomberg think he wouldnt have to listen to her order?

That's cool ... that's exactly what we're doing here in Gloucester... we have a tent that is occupied at Dewey Sq. 24/7 with 'somebody' and we have our own tent out on the most wretched (elements-wise) spot on the shore up here where we have someone greeting inbound ships with a boat horn and a sign. My 12 year old boyscout and I were camped there on night this last weekend and a 5 story tall Norwegian Cruise Liner blew it's big horn so loud it shook windows in the neighborhood a 1/2 mile back from out position.
N.C. Huh? My Nephew is a drummer/ teacher in Charlotte with a jam band.

skippy , silly little skippy....

Then the protestors should have gone to the "land court", instead of calling thier Judge friend at home.
You can make up whatever nonsense you like about how the city can't enforce health and saftey laws on private property....thats just stupid.
Plain stupid.
No matter how hysterical you get.

Ah... so the IGNORANCE sets in and you have to rely on calling people pet names and "stupid"
I figured you'd eventually run out of ideas ... we're done. If you can't refrain from being an asshole, you get ignored.
How hard is that to get?

Tazz, because they called her at home and got her to come down and sign an order bypassing all the procedures for assigning a judge.

and the fact that she is inegillble to rule on this issue.

The NLG lawyers were talking about the land court jurisdiction ... and that's how we've fought eviction up here. In Massachusetts,  the land court is equal to yet separate in jurisdiction to superior court and 'appeals' are taken... I took the original messages to mean that was the court they were going through. Seems reasonable because regardless of grounds, they are fighting an "eviction".
Is there anyone from NY that knows the court structure that can shed a light on this?
Problem I have with believing newspapers right now is that what I have read, is almost opposite what I watched transpire live all last night.

luckydawg -> RE: Origonal OWS camp closed down in Manhattan (11/15/2011 11:26:03 AM)

yep, since you cant defend your nonsense legal thoery that the city cant enforce health and saftey laws on Private Property,

And you cant defend calling a judge to bypass the legal process, I suppose its all you have left.

Making up lies.

And.....I have never called you Stupid. No matter how much you deserved it.

I demand an apology for your false accusation against me.

And you know I never got the thank you e-mail from the Gay Mens Association you claimed you were going to donate to in my name....

where you lying about that also?

Seems to me thats why its called a temporary restraining order... I do believe the case is being heard now.

luckydawg -> RE: Origonal OWS camp closed down in Manhattan (11/15/2011 11:36:14 AM)

Wow, your comprehension is way off today. Hope you feel better soon.

You asked why The Mayor was ignoring her ruling. Which is what I answered.

tazzygirl -> RE: Origonal OWS camp closed down in Manhattan (11/15/2011 11:42:02 AM)

Yes, he is ignoring a temporary restraining order. On what grounds?

And before you start on about the "hierarchy" of the judicial system... something besides your own belief of such is required.

luckydawg -> RE: Origonal OWS camp closed down in Manhattan (11/15/2011 11:47:38 AM)

No, actually it is not.

The protestors are out of the park.

The restraining order was used to wipe ass with.

And a real judge, selected in the proper manner (not an activist friend called on a personal phone line in order to bypass the system) is considering the manner as we speak.

and Judge Ugly was not eligible to be in the pool to be chosen as a real judge.

So you can actually read about the issues, or you can get your news from silly skippy and be confusled about why he is ignoring the worthless order.

My belief is not a factor in any of this, at all.

tazzygirl -> RE: Origonal OWS camp closed down in Manhattan (11/15/2011 12:01:12 PM)

I am reading about the issues. 62 Supreme Courts in New York, one for each county.

Hierarchy...

http://www.courts.state.ny.us/courts/structure.shtml

This has more to do with the fact that the Judge issuing the retraining order has a history of working for the ACLU than her real estate history with the courts.

And been replaced by whom, lucky?

Maybe this will jog some memories about the "impartiality" of the "chosen one".

luckydawg -> RE: Origonal OWS camp closed down in Manhattan (11/15/2011 12:10:07 PM)

well I dont see a personal phone call to choose a sympathetic judge anywhere in your flow chart.

Why do you pretend to not understand why NOT following the Procedure makes a ruling invalid?

And you pretend to miss the point.... I suppose you are using your play dumb trick again. Frankly, Its beneath you.

Its not WHO the judge is but HOW the JUDGE GETS CHOSEN.

The reason she got the early morning call to bypass the judicial system for political reasons was because of her ties to the ACLU.

So you are in favor of Bypassing the Constitutional Political System for Politics?

tazzygirl -> RE: Origonal OWS camp closed down in Manhattan (11/15/2011 12:15:31 PM)

You have yet to show me anything that states a particular Judge must be contacted to issue a restraining order in NY.

We are all still waiting on that little gem.

If it weren't for personal phone calls to sympathetic judges, do you think an after-hours search warrant would ever be granted?

It flows both ways.

Fact is, Hill, he is full of shit... as someone verified for me in cmail.
