FR IMO big mistake to exclude the pilot and to include the airline at all. From all reports it was the pilot and the pilot alone who refused to let them on the flight. At this point the best and only real choice they have is to settle. Sad really because they have a legitimate case.

They have a case against the airline because the pilot is an employee, but also, until all policies come through and the depositions occur, it remains to be seen if the pilot violated policy or if he was acting within the scope of the policies Delta has. All in all, to me, if there were other muslims flying on Delta and who fly on Delta, it's kind of hard to prove that Delta discriminates against people being Muslim, however, they are two specific people and the pilot's insinuations were pretty clear as to why he didn't want them flying. They can -- even with a confidentiality clause - as part of the settlement request policy changes within Delta. We did that with one of our cases against a company and requested them to outline the plans they are taking to insure the incident never happens again or it does it's best to ensure same. It will be interesting to see how this unfolds.

I think that the pilot should be made to spend a year flying international routes that Muslims frequently use, without the authority to deny anyone on board, UNLESS the reasoning is supported by security staff. on off time (i.e. several days off, vacations, etc) during that period, the pilot should be required to spend time with a Muslim, doing volunteer work.

I dont think there is enough information to call this guy names etc. That's just silly. And with the amount of Muslims in this country. He more than likely flies with them everyday. Why should he have to spend a day with them. He is allowed not to like them. He can't however professionally discriminate against them. This is the US you can not like, trust, etc anyone you wish. However if he was discriminating against them simply due to his presumption they were Muslim and didn't honor the contact of their tickets that is wrong. However these men were singled out by many people for reasons not yet known. Angel

Why would they name the pilot? They had the contract with the airline and not the pilot, and the pilot works for the airline anyway, so it's the airline's responsibility. Personally I do hope they get compensated, if somebody would treat me like this, I would like them to feel it where it hurts them most, which is usually the check book, plus why should somebody be treated like that and not be compensated? With the media attention this case is getting, the airline will be very motivated to change their policies.

Yes, tazzy, I read it, and again, while the airline may have taken extraordinary measures regarding them boarding the flight, it was the PILOT who ultimately made the decision. In ANY lawsuit, ALL parties are named in the complaint, in other words, the name of the pilot would and should have been included. When the exact names are not known, then pseudonyms are used and the complaint is amended to include the proper names later. The plaintiffs' complaint CLEARLY states that the NAMED defendants did NOT agree with the pilot's decision. If, as stated earlier, that the pilot holds the ultimate authority, then the pilot is at fault. However, if the FAA rules dictate that a pilot has that authority, the airline can not be held accountable. What exactly is so difficult to grasp about that?

Only that the airline hired the pilot, so why didnt they remove him if they didnt agree with his decision?
