I've heard all sorts of arguments about how pepper spray is "safe", non-lethal.  Why then did a 62 year old Ohio man die after being pepper sprayed by Tampa, FL police?

That's just horrible.  How can anyone stretch their justification far enough to cover that?  What part of law says that it's alright to strip a man naked, tie him down and then spray him with what is for all intents and purposes a biological weapon - and then not put anyone in jail for that?

Oh sure, but if a few guys grabbed say two of those cops as they were going into the station and knocked them over the head and took them to a pre-selected isolated building and tied them up naked and beat the living hell out of them *then* it'd be a "big deal" wouldn't it?

...if, IF a couple guys ? That is quite revealing, you what...justify police violence because of what IF, IF a couple guys take a cop (highly unlikely) ?

How about IF, if the repubs use the new def bill and once in office round up all dems...what IF then ? See how easy it is to say IF. You sound like Dr. Phil...but what if...?

Clean up the corrupt courts which includes most statutory law which is so twisted to fuck there is no law.

4 years between death and lawsuit. The DA's office cleared the cops of any wrong doing. Lets see what a jury decides in the wrongful death suit.

This is disturbing. I understood that pepper and capsicum sprays were designed to be used to subdue violent people when the police have no other alternatives available except firearms. I understood that the police concerned ought to be under some kind of threat unless spraying was undertaken. These sprays are supposed to prevent unnecessary deaths, not cause them.

None of these conditions appear satisfied in this account of this incident. I don't know whether it actually constitutes murder under US law. However, it appears to me to come close to any reasonable definition of murder. I hope the people responsible for this vile abuse get treated with the same amount of leniency they showed for the unfortunate victim of their viciousness.

Is any one surprised that the DA's office cleared the cops of wrong doing?

Annoyed, yes.

We had three cops here cleared when they put a music student in the hospital.

All charges were dropped against the teen. The FBI investigated it as a hate crime against the cops. No charges were filed, the case cleared by the FBI. The city then offered a settlement...

Because there is always more to the story than the radical media wants us to hear. I'll bet in this case there is another story that would make more sense and throw a different light on the officers actions…But then that would not make a sensational story.

All this may be true but then again it may not be the whole story… give it some time. Remember news organizations can say what the please but police departments by law cannot.

Here's another "IF" for you Mr Rogers, a couple of guys could call the state police and say they saw a guy sitting in his car with his pants around his ankles in front of an elementary school and give them his plate number.
Yup, it's real easy to say "If" isn't it?
Then, at some point those guys aren't going to be cops anymore are they?

I guess you condone that shit then, cuffing and pepper spraying a 62 year old man until he's dead???

I don't care what or how much "more to the story" there may be.  Nothing justifies the treatment this man received from a couple of sick cops.  The story is that a 62 year old mentally ill man was taken to the police station when he should have been taken to the hospital, stripped naked, bound and gagged and then pepper sprayed until he died of a heart attack. 

If a couple of big strong cops can't subdue a 62 year old mentally ill man without the use of restraints and without the use of pepper spray, they don't need to be carrying badges.

thats the way it is all across america.

you cannot get one gubafia agency to police another unless there is total public outcry and then there is so much of it ALL the time we would spend our lives out on the street protesting 24/7.

its beyond out of control here.

They come after people, a friend of mine just showed me paperwork from the city she lives in with a complaint that states vehicles parked in back yard.  There is not statute or ordinance stating this is not allowed.  (unlicensed however is stated but that is not the case here).  Simply cars parked in back yard!  Thats the complaint.  They then used that as a pretext to waltz onto her property and inspect the whole premesis in search of any possible code violations.  They simply drew assumptions write up a ticket and now she has to pay for an appeal for their decision.  They are supposed to operate off of a complaint since they are not a police organization yet have a loophole built into the law so they can circumvent releasing records to the public to insure they are not operating as a police agency.  Needless to say they are policing the area looking for things they can write up on people!  A police state!  Then they obstruct you from checking on them, they do not release the name of the complaintnant so she can face her accuser and force her to go into court you need to file for writ from the court,  you can no longer file your own write as you could before the 1776 revolution.  They gave her a copy of the complaint and there is a specific procedure they are required to follow before they can deny release of information.   They completely skipped one step and only did 3 of the 4 other steps required by law to make the decision and for her to get remedy she is forced into filing a suit against them!  So they have gubafia agents writing people up acting like police agencies, the same agencies have judgment power by statute to police themselves so they can hide behind the corporate veil.  That is how they operate!  Its attrition.  Its expensive for her to piss away how much time going to court filing suit just to get the mob off her ass, worse for something that is in code and their misapplication of the law.  This can all be neatly swept under the carpet as incompetance and or error rather than what it really is, "negligence" and collusion.  Just like 911.  Its at all levels of government.  They extort money from people by literally misleading them and failure to perform their jobs properly, hence few people have the time to catch or get wise to what is going on..  The laws created to protect the people against this were gutted by the courts.  There is not remedy in the courts, no way to fix this shit.  This country is so totally fucked.   Its so costly to fight these people that every one simply pays them just like they did Al Capone!

This is nothing more than one gigantic penal colony of plantation slaves/

oh and her car was legally parked btw.

erieangel I do as well if this played out as in the news story... I will be interested to see the evidence in the civil trial. But... I'll bet there will be more to the story then the media story.

Butch, at this point, I'm very interested in your opinion of what could be more and make what these two cops did to this guy justifiable.  I will admit that I view this story with a bit of bias, being mentally ill and working with people who are mentally ill.  I've never been restrained though I know people who have been and it was always done by mental health professionals.

The mentally ill are treated worse than murderers in way to many cases.

Its despicable and so are the cops in this case. I hope they get what they deserve, but then ... its too late for that
