personally when anyone starts trying to delay something at an airport just cos they can, Im not thinking very kindly
Fucking security is a pain in the arse without some dick head reciting his rights and causing the queue to slow to a crawl
Im not american, lots of people arent and I want to get to my destination ASAP ....write to your fucking congressman, but dont be a dick head at the busiest time of the year in an AIRPORT where you KNOW what you are going to face
think about others not your selfish right hold everybody UP just to to" blah blah blah."

OK, how stupid can one person be? Reading thru it, all I can say is she is just too stupid for words. I hope she feels vindicated or whatever by writing this......warrants??? I mean, puh-leeeeeeze. For Christ's sake, we've had to deal with all this crap at airports for years.....I fail to see what the big deal is, and I'm an ex-cop. Constitution my ass......her pleas for cameras and you tube footage? She got what she deserved. Her actions did disrupt the process, and even the other passengers had no sympathy for her.

And for the conspiracy thoerists out there....bunk! I'm all for civil liberties and not getting my rights violated, but I've learned that if you fly, you're going to have to go thru the security crap. It's not perfect, there have been people that have gotten thru, and thank goodness, their attempts to bring down a plane failed, but gone are the days when we can just trust everyone coming into an airport.

I still can't believe how stupid this woman was. This'll leave me shaking my head for a few hours.

While it may be a stretch, interfering with a flight has been a crime for over 40 years (Jim Morrison was arrested on that charge, once). I think that technically, that is what this person was doing (causing a delay could be seen as interference).

So, while the author may want to spin that they were arrested for exercising their right to free speech, what they were doing was nothing more than being a pain in the ass.

Now, I am a strong proponent for free speech and I think we've lost too much of that right, already. I think this person could have made a better point (about freedom of speech) if they had recited the fourth amendment while doing as directed at the security station. Of course, I don't think they would have been arrested. I have been a bit miffed and said: "What do you mean 'extra screening'?" while moving to do as instructed and never had an issue raised.

The libertarian in me says: Why can't we have flights where we are not subjected to these searches, etc. as an alternative for people that don't want to endure what we consider to be illegal searches.

Yes, we understand we wouldn't be as safe. Yes, we understand we'd be risking our lives. I don't know that the extra measures we're enduring now have actually prevented attacks from any but the truly lazy, anyway. I think it is the very thing that famous Ben Franklin quote speaks to. We've given up a little liberty and I don't feel a whole lot more secure. I guess we got what we deserve.

Well, certainly the author spins her experience, but her larger point about the de facto repeal of the 4thA is, IMO, spot on. Her point about the vanishingly small chance of being in some sort of airborne attack is also true.

The point of diminishing returns was reached a long time ago, I think, with the nonsense about removing shoes. I'd guess that it would be a whole lot cheaper for the airlines to give out paper slippers at check-in, and scan the shoes like all other carry-ons.

I agree with Michael's last paragraph. It's not possible to ensure security with 100% certainty. In attempting to do so, the majority who support such measures have taken away MY 4thA rights.

Important points to consider:

1) This happened at a ground checkpoint, so 'interfering with a flight' and all that wouldn't be relevant.

2) If the legal and constitutional standard for preflight screening is, as the supreme court said, "Prevent dangerous weapons from being admitted onboard" than the shenanigans the TSA has invented don't meet that restriction, and should be challenged.

In Katz v. United States, 389 U.S., 347 (1967), the Supreme Court ruled that the 4th amendment's protections apply only when the searched party has a "reasonable expectation of privacy". Going through the airport scanner or, more obviously, deliberately refusing to and intending to take the personal pat down clearly indicate that there was no "expectation of privacy", hence the 4th Amendment protections would not apply.

Of the thousand way to express your dissatisfaction with the TSA's methods (which I disagree with as well), showboating at the scanner while on the line in the airport has to be amongst the stupidest.

Airport security is a pain in the arse. Rather that than another terrorist attack though. 9/11 wasnt the only plot, just the one that got past security. Lets not forget the plans to use liquid bombs on flights to the US from the UK in 2006.

If by reciting her rights, holds up the preflight security and I miss my flight for her selfishness, yes its interference with MY FLIGHT
and BOY am I gonna be PISSED and liable to find a sneaky underhand way to pay the dumb bitch back.

In what world do you live where an airline will hold your flight up if you're delayed at the TSA screening in the concourse?

That's a much nicer one than the world everyone else is living in.

The supreme court ALSO ruled that airport screenings are legal ONLY as long as they're limited to the purpose of preventing dangerous weapons from entering the airplane.

And traditionally, until George Bush hired all them Government Employees we have to pay pensions for, that function has been done by the walk-through metal detectors and carry-on x-rays. And here's the thing. There's NO SCIENTIFIC EVIDENCE that the new, "Federal Employee Based" intrusive screening is any more effective, given that the root-cause of the 9/11 hijackings -- the "Cooperate with Hijackers Philosophy" has been identified and eliminated.

Since the Supreme Court set limits on what they can do at the airport, (IIRC: United States v. Davis (9th Cir. 1973) 482 F.2d 893, 907.) and the TSA exceeds those limits, that is why the 4th Amendment is being violated.
