President Barack Obama’s name will remain on the Georgia primary ballot after a state law judge flatly rejected legal challenges that contend he can not be a candidate.

In a 10-page order, Judge Michael Malihi dismissed one challenge that contended Obama has a computer-generated Hawaiian birth certificate, a fraudulent Social Security number and invalid U.S. identification papers. He also turned back another that claimed the president is ineligible to be a candidate because his father was not a U.S. citizen at the time of Obama's birth.

The findings by Malihi, a judge for the State Office of Administrative Hearings, go to Secretary of State Brian Kemp, who will make the final determination. Last month, at a hearing boycotted by Obama's lawyer, Malihi considered complaints brought by members of the so-called "birther" movement.

With regard to the challenge that Obama does not have legitimate birth and identification papers, Malihi said he found the evidence "unsatisfactory" and "insufficient to support plaintiffs' allegations."

A number of the witnesses who testified about the alleged fraud were never qualified as experts in birth records, forged documents and document manipulation and "none ... provided persuasive testimony," Malihi wrote.

Addressing the other claim that contends Obama cannot be a candidate because his father was never a U.S. citizen, Malihi said he was persuaded by a 2009 ruling by the Indiana Court of Appeals decision that struck down a similar challenge. In that ruling, the Indiana court found that children born within the U.S. are natural-born citizens, regardless of the citizenry of their parents.

Obama "became a citizen at birth and is a natural-born citizen," Malihi wrote. Accordingly, Obama is eligible as a candidate for the upcoming presidential primary in March, the judge said.

Even though Malihi ruled in Obama's favor, he expressed displeasure that the president's lawyer, Michael Jablonski of Atlanta, refused to attend the recent hearing.

"By deciding this matter on the merits, the court in no way condones the conduct or legal scholarship of defendant's attorney, Mr. Jablonski," Malihi wrote. "This decision is entirely based on the law, as well as the evidence and legal arguments presented at the hearing."

Good for Judge Michael Malihi, especially given that judges in Georgia are elected.

I wonder why President Obama's lawyer didn't appear? I think he should have.

Why should he?  Doing so would have given the impression that there was any legitimacy to the claim.

Had the court ruled against Obama (not bloody likely), then Obama would simply ignore Georgia and win the Democratic nomination anyway.

If he had, he would have set a bad precedent. He'd then be expected to appear at every looney-tune's (birther, spiritualist who got a "message" from the dead, believer that the President is actually an alien from Alpha Centuries, etc.) court filing and not have time to do the real job he's on retainer to do.

Then the learned Judge should not place the onus on the defense attorney to make sure NO TAX PAYER RESOURCES BY XWingnuts ( which is what I will call WingNuts that have come completely unscrewed... I want them to think their worth their Mountain Dew ... presuming it causes heart disease) ... Pressing cases that are UTTERLY FRIVOLOUS. The Judge upon recieving the case has an option to review the arguments (and THE CATALOGUED EVIDENCE... If it ain't PlayLawyering<tm>)... and declare in a simple writing that the case has no merit. Having NEVER seen ONE credible case filing, this should be a walk in the park for most judges.
   The facts are Atty Jablonski gave answer and strongly urged the judge to save the people's time and money. The Judge apparently wanted to use formality to make an embittered political statement albeit ineffective.

Filing an answer and refusing to appear in some jurisdictions is a statement. The attorney does so to press the rights of a defendant who is being harassed using the very justice being applied. And in places where a case like this would be asigned to a thinking judge, this paltry comment wouldn't have even been entered. Answer filed ... should have been dismissed for frivolity.

Your loss, you missed the ONLY entertaining aspect of the page.
The fact is how many times do OFFICIALS have to be brought forward to say the same thing about the facial validity of the documents presented before a judge offers a Plaintiff a chance to withdraw in advance of a frivolous case decision comes down, and once refused hand down a HUGE fine for bringing it and refusing to withdraw.
   You know how we hear every once in a while how a lesson needs to be taught through a judgement? Or a message should be sent? Well simply stated, this is one of THE BEST examples of one of these opportunities. The Judge in Georgia BLEW IT in my opinion. Again, obvious judiciary political activism. Where's the "activist judge" crusaders now?

The ruling is quite logical. The judge wants to keep his job. My guess is he also had a private visit by a man in black suit who explained what his choices are.

the only way a county could have any jurisdiction is if it were illinios presuming he claims to be a citizen of ill in the first place.

secondly anything short of quo warranto they can wipe their ass with it.

last if the writer of that article knows anything about what they are talking about that was a fucking "admin" hearing!

more bullshit propaganda showboating.  He is not eligible to be the el prezidante as he is completely disqualified under the statutes at large, 1802 immigration laws.

Yanno, after giving the matter some thought, are any of the 'birther' crowd ever really 'happy' about anything? Sure, they might say that they're happy, and often they've been gleeful etc at having beaten or harmed somebody, but really, how many of 'em ever seem truly "happy"?

They're mostly unhappy, angry, etc.
