I have to say, more and more, I am glad I live where I do. We are not perfect, far from it. But for now, women still have control over their own medical care. Racism is frowned upon. We have fair employment laws that protect both the employee and employer. Murder is still murder. Birth control is legal and covered by our health insurance plans.

And over all, people are damned nice and reasonably level headed.

Yay for Iowa........shame on Florida.

Yachtie -> RE: Another rusty star for Florida. (3/20/2012 9:02:27 AM)

On topic to the link -

Iowa is an at-will employment state. The term at-will presumes that employment is voluntary and indefinite for both employers and employees. Either party can terminate the relationship at any time. For employers, however, there are some exceptions to the at-will doctrine.

Try telling that to the judge at a workman's comp hearing. I had to provide documentation of two years of incompetency to justify my firing of an employee that had only been an employee for less than a year. If any company here tried what that law firm did, their asses would be soooooooooooooooooooooo sued and not in an inexpensive way.

DaddySatyr -> RE: Another rusty star for Florida. (3/20/2012 9:17:51 AM)

How does one demonstrate 2 years of incompetency from an employee when that employee worked for less than a year? Or was that a typo? That's how it reads, right now.

Peace and comfort,

Michael

OMG! I could never wear Orange! I would paint my walls Terracotta but never Orange.. sheesh, what were these people thinking???

Really dumb manager and company.. if the manager thought the color thing was a protest,.. that just means its a shitty company to work for if he/she thinks employees have reasons to do that.. Too bad they didnt print the company's name so anyone possibly looking for employment there knows what they are getting into.. [8|]

You read correctly and that is what they wanted. Your question was also my question.

That is so fucked up.

TN is also an "At Will" state but when I was on the trustees of a fraternal lodge, we fired a bartender for stealing. We took the evidence to the unemployment hearing and even though the judge saw she was stealing, she was still awarded unemployment.

did you call the cops and have her charged? did she pay any restitution for what she stole? I expect we are talking about more than a few pens and paper clips, huh?.. [8|]

How did she manage to steal anyway? most companies have safeguards in place to prevent that..

I saw the Dead in Des Moines in like 80 or 81 and I would have to agree with ya about the people there.

In another clothing-related layoff, Debrahlee Lorenzana was fired from her job at Citigroup in New York in 2009 for being "too hot," at least according to her. She filed a lawsuit in 2010 after superiors became increasingly specific about her attire, insisting that while she could continue to wear makeup she should refrain from wearing high-heels since they "drew attention to her body in a manner that was upsetting to her easily distracted male managers," according to the lawsuit.

Well, if I ever need a law firm noted for its intelligence and capability, I know one place to overlook.

Several hundred dollars, yes and no. it was never more than $30/40 at a time.

It would be hard for a person to explain to prospective employers why they were fired when they stole from a previous employer.. sorta makes a person almost unemployable.. in a very odd way i can see why she was able to get unemployment, although morally she shouldnt since the firing was due to her own actions..

The firing may have been perfectly legal; I'm no expert.

But that doesn't make it any less boneheaded.

I've only been in Iowa twice. IIRC, it has a lot of corn and loads of antique shops. I like corn and antique shops. Also, and most importantly, Captain Kirk will be born there in a bit over 130 years, so yay to Iowa. I'm a fan (even though you don't like Texans!)

LaTigresse -> RE: Another rusty star for Florida. (3/21/2012 7:42:20 AM)

I only dislike the Texans I've personally been around...still waiting on some to prove me wrong on 'all'.

Absolutely legal. Had all the fired been women (or men), veterans, members of a specific race or gender or religious group, then it would have been illegal. But employers are permitted to hire or fire for any other reason.

I checked out the firm's website. They do defense against foreclosures. They've been around for nine years and have evidently done quite well, what with the unnamed executive who fired all fourteen. I'd estimate there are at least 20 employees there. That's at least $2 million a year revenues.

I'm having a hard time thinking of any executive who could do such a thing and not get chewed and/or fired by the firm's founder. I suspect that the "executive" was the founder who declined to be identified by name, and that she's nuts. My guess is that the company got stressed financially (lots of payroll, and the clients are already known to not pay mortgages, so they'd be poor prospects for paying bills), and that she simply fired them when she was having a bad day and suspecting a nefarious plot.

Charles6682 -> RE: Another rusty star for Florida. (3/21/2012 10:30:21 AM)

Would people quit always hating on Florida all the dam time.It gets old.I am from NY myself.Sure, its not perfect but dam,the rest of the country just loves to hate Florida until winter time comes and then all of a sudden its time for DisneyWorld and te beaches.Heres how it goes, there is Florida(tropical beaches, lots of sunshine and warm winters) and then there is "FloriDUH",the other part that is nothing but a swamp full of some rather mean people.Okay, does that clear things up?!
