I was going to post on a D/s website and there was a User Agreement that said, "You may not join if your State bans BDSM or explicit pictures on website"....I was like ?*#?@?

Does anyone know the list of states that actually ban BSMD related websites? (Boy, call me niave!)

I used to live in Utah.. and it's not really all that underground. There is quite a large community there in Salt Lake City, several groups.. even a few adult stores to buy toys and fetish wear.

You just can't get anything over 3.2% beer unless you go to a private club.

Obscenity laws vary wildly by state, county, and city ordinances. You can get caught up on any of those, if somebody is really looking to nail you for something. All my information is WAAAY out of date, like a decade or more, but it wouldn't surprise me a bit if BDSM was still counted as sexual assault in some areas of the south and midwest. This does not mean that it isn't practiced, just that there are some really strict anti-sodomy laws that include any form of non-vanilla-missionary-position-and-therefore-theoretically-procreative sexual contact.

What burned the reality of it into my brain, as an impressionable teenager, was the man who was imprisoned for aggrivated sexual assault and sodomy for tying up his wife and then going down on her, in the privacy of their own bedroom. She used it against him in a later divorce case, not only getting the judge to rule in her favor but also getting him thrown in jail in the process. This was almost twenty years ago, but these laws often lurk in the books for decades without being changed, because it never occurs to most people to look up the laws in their state and find out that, for instance, pigs must wear pants on sundays.

Actually, the more vehemently a society cries out against this sort of thing, the more kinky their society turns out to be, by and large, under the thin veneer of pseudo-respectability. Of course, historically speaking, you can learn what sorts of things people do socially by reading the etiquette guides of the day. Everything the zeitgeist of miss manners tells you not to do, is exactly what everybody happens to be doing at that time.

Funny thing, that.

John, I'm curious as to how explicit this is and if there are any riders which went along either explicit or implicit when thay handed down their ruling. For example if you take the ruling literaly, and I visited Mass and hit some dude who was trying to knife me then I should be charged with assult after he is charged with either assult with a deadly weapon, attempted armed robbery or attempted murder.....

here in Queensland it is assult to shine a flashlight into some ones eyes deliberately, or even deliberatly fart at/on another.

I think most states have laws about not being able to consent to being hit probably it isa design to fight for domestic abuse victims who can be 'convinced' to drop charges.

I think it gets used against people who do BDSM when they are reported by busybodies or it comes in in divorce cases. I have yet to hear of the police looking around for folks who do BDSM.

Not really there is a provise which allows you to use a flashlight to illiminate the person you are checking out which has sence because you need to make sure that they haven't a weapon handy but direstly into your eyes to blind you for intimidation reasons is a no go.... It often depends on the reason and situation. Sort of like I can carry a side arm hidden or open on a belt to protect property but I am not allowed to use it in the defense of property but although I may not carry a weapon to protect a person I can use a peopon to protect them, especially if the offender is armed and in that case and provided there are no alternatives and I believe that lives including mine are endangered I can with impunity use lethal force.... This is from both the current legal standing and from experience. Thus if I was paid to body guard you, you would sign a document stating that you were either wearing or carring valuables and/or documents (unspecified) of an unspecified value. this allows me to be armed and use deadly force at my discression provided it was within the boundries set down by both legislation and current convention. (naturally I would need to be licenced under the security legslitation and have permist for carrying weap[ons as prescribed by law and in a manner as acceptable by law. (I still have credentials which over rule state laws as to what, where and how I carry weapons and for what reasons I carry them if I carry one at all).

Consent is not a defense.  Self-defence, but you really really have to be at risk.  Your first duty is to flee.  That's why I live in Florida and have a carry permit

John this has piqued my curiosity. Ok I can agree with the self defense but let's assume that we take two other examples. In the weapons area of most Martial Atrs you are going to get hit with some form of big stick to which by the reason of you training you have conscented to being hit if your defences are not up to scratch. the same thing applies to groups like the SCA combat where you are beating up on each other with sticks... If the defence is that it is a sport, then surely a case could be made that a Master beating a trainee for the beating is part of the trainee's toughening up process. If that can be sucessfully made then a Master using a crop on a sub/slave's botton could (by stretching things) that this was a training session designed to increase tollerence of pain ..... I immagine that the courts would have problems if the defecse claimed it was punishment though..... I'd like to believe that the Law has allowed for rational and acceptable reasons for plonking a tree branch about another person's anatomy.... I guess a claim that the folks were living a traditional cave man lifestyle huh?

Hello A/all,

It is not puzzling me about the idea in Massachussetts that hitting a person is considered assault.

Well, I hit somebody in California and it would be considered assault.  However, if the person I hit does not file charges against me, charges are not filed.

Are you stating that in Massachusetts the District Attorney will file charges against you even if the "victim" refuses?
