Warmest sympathies, Rich! That's an unspeakable violation, and I totally understand feeling frustrated, even murderous. I hope the cops nab Dumb Dora quickly. And I hope the bank has the decency to return your money,

Two questions (which you may have already asked) for the branch manager: (a) why did the teller cash a check that exceeded the account balance and (b) didn't s/he require some form of ID?

I hope and pray this gets resolved quickly!

I've been dealing with an assistant manager at my branch, DC. I darn well asked why the check was cleared, when I had declined the overdraft protection, and she told me that was specific to the card. The decision to honor was reached inside the computer system, probably based on a 10-year direct deposit history.

She did have to show i.d. She even gave a thumbprint. She made the check out to herself, wrote "rent (owed)" in the memo, and likely pitched a story about her roomate finally catching up on the back rent. The address was the same as hers, after all. What I want to know is, why they didn't compare the darn signature. It's in the computer, not just on a 3x5 card at the home branch anymore. Even Dumb Dora's dumber brother Donald would have noticed they looked nothing alike.

Stay on the cop's ass. Unfortunately in some towns, they don't see financial crime as "WEAL and TWUE" crime and would rather be out harassing people who do things like jaywalk.

You might have to let them realize that you aren't going to shut up until the bitch is in jail. (make sure you tell em it's a bad idea to accept a check as bail money)

I had a Dumb Donald years ago when I worked the customer service desk at a large retailer. He stole his neighbor's UI chq out of the mail and used it to pay his own account. Uhhh, he got caught, was charged and did some jail time since this wasn't his first offense.

Good luck and hope the bank is quick at getting you your money back.

That's the blessing of having my card rejected at the grocery store only a couple hours after she cashed the check, and getting the fraud report in - it hadn't yet cleared the overnight processing, and the money was accounted to some internal system, rather than actually being transferred out of mine. I was able to withdraw everything that had been in the account, plus the direct deposit from work, first thing the next morning.

Not really, Kalikshama. It's a lousy image.

The detective called this afternoon. He was in court all morning, but let me know he was going to the bank to get the video record of the transaction. That will be just as conclusive, and doesn't require getting the police lab involved. The detectives can just show her the tape, threaten her with the thumbprint, take her confession, and hand the DA a neat little package that never needs to go near a courtroom.

Have they given any indication of what time she might do, if any? I am really hoping this doesn't turn into a community service thing, but, with the overcrowding everywhere, I wonder.

I don't know, Jst. I think it will mostly come down to what her prior record looks like. California has a whole new set of guidelines, under the new, "realignment" policy, that means if she goes to jail, it will almost certainly be county time, rather than state prison.

if the police don't move quickly enough on this you might want to consider speaking to your local television stations. many of them now have a complaint reporter who will investigate the response or lack thereof on behalf of their taxpaying viewers who would most certainly be interested in such a bungled investigation.

I'm getting the impression a fair number of people must live in quiet places, without much crime. This isn't one of those places. Let me paint a bigger picture.

Just a few weeks back, less than a mile from my old house, a three tour veteran of Iraq and Afghanistan was shot to death in his car, right in front of his brother's house. Probably a mistaken identity gang thing, but no suspects. Home invasion robberies are on the rise. A man was stabbed in the head with a meat thermometer in the local movie theater, because he "disrespected" a woman by asking her to take her cell phone call out to the hall (that guy got prison time). A story in the paper today was about a man who was assaulted with a taser in the WalMart, over a bumped shopping cart.

My local cops have murders, and stabbings, and people beaten, terrorized, and robbed in their own homes. Hit and run drunk/drugged driving accidents. Armed robberies. Domestic disturbances with lots of blood. We moved the hell out of that house, buying at a lousy time, because we were tired of the police helicopter orbiting overhead, and putting their spotlight into our back yard 3 nights a week, and the sirens that wailed past on the boulevard at least twice an hour, 24/7. It's frustrating to wait around on such a clear cut, simple thing, yes, but the police are busy.

This is just Dumb Dora. Dumb Dora is so dumb (how dumb is she?), she put her own name and BLANK on somebody else's check that showed up in her mailbox. The cops can go get her on their way to a bathroom break at the station. Eventually they will, because this is just as easy as police work gets, and everybody loves a high conviction rate.

I really appreciate the good wishes and interest from everybody, because this is damn irritating, but please, don't anybody think of my situation as more than it is. Once upon a time in my life, if somebody took my shit, I'd be going out to get it back. I'm much calmer now. Really. Mostly. Rude jokes about the perpetrator help.

Geez, Rich, WTH? California used to be The Gilded State, and it's turned into Hell. My kid brother lives in a nice Sacramento suburb, and it went to hell with petty crimes like car keying, etc.

It amazes me that the bank has fifteen levels of fraud detection, and they all just rolled over for a random dumbshit. If someone was halfway intelligent, the bank would be flummoxed.

This is kinda OT, but why use a bank in this day and age? A CU is friendlier, gives better rates, and won't envelop you with levels of bureaucracy at times like these.
