I know Texas and Florida are worlds apart(or are they?) but their version George Zimmerman just got 40 years.

"A Texas man convicted of shooting and killing his unarmed neighbor during a dispute over loud music received a 40-year prison sentence on Wednesday.

Raul Rodriguez, 47, faced a minimum of five years and a maximum of life in prison. He claimed he shot schoolteacher Kelly Danaher in self-defense under Texas' version of the "stand your ground" law.



But prosecutors argued Rodriguez provoked the incident by confronting Danaher, 36, and his friends with a handgun and demanding they quiet down at a late-night birthday party in May 2010.



The Houston case captured more attention in the wake of Trayvon Martin's death in Florida. There, George Zimmerman says he was being attacked and cited the state's "stand your ground" law after shooting the unarmed teen. But prosecutors charged him with second-degree murder."

Texas man gets 40 years after "stand your ground" defense fails.

"Prosecutors argued that Rodriguez had provoked a standoff with the party guests by shining a flashlight at Danaher's house from the roadway. Defense attorney William Stradley called it a "perfect storm of events" with no evil intent from Rodriguez.

If not for threats from intoxicated party-goers to "get even," Rodriguez might not have felt he was in imminent danger, Stradley said.

A person contemplating murder does not call the police beforehand, he said. Stradley told jurors the case hinged on just the two seconds before Rodriguez pulled the trigger."

Like Zimmerman, Rodriguez was terribly stupid but seems that there was plenty of that to go around. If someone is outside your home with a gun and you go inside to get your gun and come back out (intoxicated or not) I don't have much sympathy for you. If they had no returned Rodriguez' provocation in kind and just called the police nobody likely would have been hurt.

The "contemplating murder" comment holds true in both cases.

Again, after watching this I don't have any issue with the verdict or sentence but I have absolutely no sympathy for the dead guy.

An elementary school teacher, no less. Wonderful.

This case was discussed ad nausium in stand your ground II Stand your ground did not protect him because he was stupid. It is stand your ground not go onto the other guys ground and threaten him.

Too, he seems not to notice that the failure of a "stand your ground" defense in Texas, and another possible failure of one in Florida, indicate that the law quite precisely does NOT make it legal to shoot anybody you want as long as you claim you were scared, as the usual chorus likes to sing.

According to one witness, Rodriguez told her that under the SYG law, he could get away with killing anybody (or words to the effect), that is not stupid thinking it is dangerous. Rodriguez did believe he was standing his ground, not in much as a geographical sense but in a moral sense.

He didn`t even live there and killed a resident.......



No wonder we have this extremely hard to believe fairytale, about do-gooder George having an initial ,non-violent "meeting"with Martin and then peacefully parting ways, only to have young Martin circle back and attack poor George.....unprovoked......


They need that story......otherwise he`s fucked......

What most folks think happened.....a wanna-be watchmen oaf and world-class fuck up who tried to hold the kid at gun-point,ending up shooting a resident durring a struggle over the gun.

If that`s what happened.......George can`t use the SYG defense


The most pronounced similarities at this point.....are the 9/11 phone callls.



One can hear George prepping the same way this guy did......."he`s looking in houses,he looks like he`s on drugs,he`s got his hand in his pocket",.....all with an I`m scared tone of voice......No wonder the cop said not to follow Martin......

It seems the guy in Texas was looking to go after some one because he was pissed. He brought a gun near some ones house and was looking for an excuse to shoot some one and trying to set up his defense with a 911 call and a video camera and then started flashing his weapon. Any piss ant with half a brain would have let the police deal with the noise situation which they ultimately would have. Not even close to the same situation as Zimmerman unless you're anti gun, start making things up and spinning it any way you like it.

Trayvon Martin Father was a resident there, the police have concluded Trayvon had a legitment reason to there.
