Independent commentators have been saying Roberts realizes the credibility of the court is on thin ice after Bush v. Gore and Citizens United, and that they would probably let the bulk of this stand. That also says something about where public opinion overall sits. If Obama wins in November, that will settle the issue, and businesses will move forward with long term plans. If Romney is elected, the uncertainty will continue as he threatens repeal. But a lot of this bill is popular, despite your view of it, and Republicans know they can't really do that--hence the "replace" jargon. But they had years to do what they wanted if they had wanted to. They didn't. Whether it's popular or not, this will go down as Obama's great achievement.
