Following his conviction, for which he served one year in federal prison, Mr. Nakoula had been ordered not to use an alias or access the Internet without the permission of his probation officer.

He agreed to the conditions of his parole and then broke at least two aspects, using an alias and using the internet. He should go back to prison just like anyone else who violates their parole.

Do we know this to be the case, Tazzy? That he personally did the posting? Now clearly, from the way his name finally came out, it is clear that he has been doing business under aliases, which does seem to be one of the conditions of his probation on the earlier charges. That's plenty. He certainly drew attention to himself, which is never a wise move for people on probation.

But that doesn't change the look or feel of locking somebody away, because he made a movie.

It doesn't change that the administration took their time making the decision to do that, or tell us how high the decision might have gone, to be made.

We threw his ass in jail on a technicality, because he said something people don't like. That's the truth of this, and I don't like it.

And yet the movie is what lead them to him. Its because of that movie that he was found out.

And there is what is troubling to me Tazzy. Values are coming into conflict. From the criminal justice perspective, he's busted, and that's all there is to that. I get it. I'm a free speech kind of guy, though, and how casually that perspective is dismissed, and even mocked, doesn't sit well.

You know what's really interesting about this "movie" is that there's no mention or indication of its classification (board of film classification).

Funny how some people are going on about the 'first amendment' rights or free speech but thing is, if you make a film there is also the issue of 'public decency' which is why you have a board of classifications to begin with.

You can't just exercise your freedom of speech by making a film which offends whoever for whatever reason (if that is your intention) without classifying your film and putting a classification notice at the start of all materials pertaining to the film.

I find this story a little bit troubling, and I'm curious how others who live under the protections of the First Amendment feel about it.

Yes. He was arrested for violating the conditions of his sentence on a prior conviction, not for the movie. I get that.

No, you dont still get it...... he was released on parole and through the release of the film was found to have violated the conditions, hence the recall to jail.

Its plain and simple, unless you are casting aspertions on the Judge who oversaw the parole case you have to believe he acted in good faith.

He's in jail because he was a fucking thief and meth dealer out on parole and he violated that parole.

He stole hundreds of thousands of dollars, he had multiple Social Security numbers so he could steal more. He also was convicted on manufacture of meth charges and served just over ONE year but you fucking bleeding hearts on the Right think he got a raw deal because he got tossed back in jail. Based on the amount he stole and the poison he was manufacturing, he should have been left there to rot in the first place.

Arresting someone who...

1) committed a crime,
2) was convicted of that crime,
3) was given early release to return to society
4) agreed to certain conditions for parole
5) could not abide by the conditions of that early release

I dont think there are far too many people in jail for nonviolent crimes.
I have reservations about the legalization of pot.
Convict an occupier of a crime, offer him/her parole with conditions, catch them breaking those conditions, send their asses back to jail.

They threw his ass in jail because he was a big time thief (Hundreds of thousands of dollars) and a meth dealer who broke his probation be taking on more aliases. The internet access, much less the film wasn't mentioned.

Interesting how we have those speaking out in defence of the 'first amendment' rights and freedom of speech of a convicted felon for posting a film of dubious quality and hateful content against Muslims on the Internet.

Yet when the subject turns to the first amendment rights and freedom of speech of Shaker Aamer, an innocent Muslim charity worker held indefinitely in solitary confinement in Guantanamo Bay despite having been cleared for release in 2007 all of a sudden there's this almighty silence.

If the conservatives don't like your politics then torture and being held incomunicado is fine. If they do like your politics enforcing a parole agreement is striking at the very heart of the Republic.
