Erika Menendez was charged in the death of Sunando Sen, who was crushed by a 7 train in Queens on Thursday night, the second time this month a commuter has died in such a nightmarish fashion.

Menendez, 31, was awaiting arraignment on the charge Saturday evening, Queens District Attorney Richard A. Brown said. She could face 25 years to life in prison if convicted. She was in custody and couldn't be reached for comment, and it was unclear if she had an attorney.

Menendez, who was arrested after a tip by a passer-by who saw her on a street and thought she looked like the woman in a surveillance video released by police, admitted shoving Sen, who was pushed from behind, authorities said.

"I pushed a Muslim off the train tracks because I hate Hindus and Muslims ever since 2001 when they put down the twin towers I've been beating them up," Menendez told police, according to the district attorney's office.

Sen was from India, but police said it was unclear if he was Muslim, Hindu or of some other faith. The 46-year-old lived in Queens and ran a printing shop. He was shoved from an elevated platform on the 7 train line, which connects Manhattan and Queens. Witnesses said a muttering woman rose from her seat on a platform bench and pushed him on the tracks as a train entered the station and then ran off.

The two had never met before, authorities said, and witnesses told police they hadn't interacted on the platform.

Police released a sketch and security camera video showing a woman running from the station where Sen was killed.

Menendez was arrested by police earlier Saturday after a passer-by on a Brooklyn street spotted her and called 911. Police responded, confirmed her identity and took her into custody, where she made statements implicating herself in the crime, police spokesman Paul Browne said.


Since, as Islamophobes always tell us that every Muslim in the world is out to kill every non-Muslim, should we call her actions a "pre-emptive strike" in the "war against Islam"?

Or should she be locked up in a prison cell for the rest of her life?

B.  Mental institution.  This woman needs some serious help with her anger issues amongst other issues. 

To put it another way, this woman does not have issues.  She has a lifetime subscription, the swimsuit edition, AND the football phone.

B.  Mental institution.  This woman needs some serious help with her anger issues amongst other issues.

The only problem with institutionalizing her is that she will be free to continue on her crazy rampages pretty quickly.  Now if she could be sentenced for 25 years to life in a mental institution, I would be inclined to agree that is where she belongs.

From the link in the OP this was a hate crime, no more and no less. It could be the woman had mental problems but as yet thats just a guess.

Or was everybody who's making that excuse for a ridiculous sow murdering somebody in cold blood perfectly cool with the Fallujah attack and associated body desecrations because the evil muslims who did that were clearly raving mad?

I have no problem with her having a chip on her shoulder.  People can hate others if they want to. 

It is the actions that are the problem. 

This woman does not know right from wrong. 

There was something that happened recently here in the US.  Since then there has been a lot of discussion about mental health.  And for Americans to receive help with their mental issues.  I judge this woman to be criminally insane.  I think a mental institution rather than a prison would be safer for everyone. 




What happened in Fallujah took place within a different cultural venue.  Not the same.

Being a stupid cunt with a chip on your shoulder isn't any more of a mental issue in New York than it is in Fallujah.
Trying to make excuses for a murder because somebody might possibly not have all their screws properly tightened is utterly reprehensible.

Who is making excuses for this nutbag? Are you saying there isn't anything mentally wrong with someone who hates a religion (or religions, as in this case) so much that she'd act on that hatred based on what someone "looks" like? Forget, just for a couple seconds, that the action was to push a man in front of a moving subway train. If she would have simply punched him in the nose, assault, over her assumption of his religious choice, wouldn't you think there is something wrong with her? Now, get back to the action was one that was certain to cause his death, and it's that much worse. She's a nutbag. She clearly knew she was doing something wrong, else she'd not have run away afterwards. Unfortunately, NY is without the Death Penalty, so I would think whatever her sentence ends up being, it is spent in a mental institution, with either a longer pre-parole opportunity time period, or no parole opportunity. Had this been Ohio, Texas, or one of the other Death Penalty states, I'd support that sentence.

She committed a crime. She killed a guy because, in her eyes, he looked like he was either a Muslim or a Hindu, and she hated those religions. She chose to act on her hate, resulting in Sen's death. IMO, this is a hate crime knowingly committed by a nutbag. I would not rule out preconception, though I would not automatically assume it was, either.

What excuse am I making for her?  I have given a reason for her actions.  She is nucking futs.  What she has done is wrong and I think that she should be locked away for her actions.  She is crazy.  A danger to herself and others.  Or is your problem with the fact I think a mental institution is a better place than the prison system?  I have not excused her actions.  I do not think that these are the behaviors of a sane person from a western culture.

Neither is using Islamaphobia to scare folks (and make money,like the rightist media does).

Before MLK was shot through his throat.....Hover,a top law enforcement officer and head of the FBI would call King the "most dangerous man in America"

Really now,how long before weak minds takes the bait?

Rightist media has been fanning this hate for more than ten fucking years.

Not calling fox news Hover-like....but their viewers............everyone  knows how impressionable and gullible and how easily mislead they are......

Based upon what (little) I know at this point in time about the case: she is a murderer... plain and simple.

If she does have a genuine mental illness that prevented her understanding the consequences of her actions and/or understanding the difference between right and wrong... that is, I believe, what they call an affirmative defense... which puts the burden of proof on her.
