Just because I dont agree with you, falling into lock-step at your "command" (sound familiar anyone?) doesnt mean I "dont know history".

But you agree with your friend whom I have proven wrong on many, many points.

And, for your efforts you have won...

For the record:

I know that Tazzy knows her history.

I like Tazzy even though we dont agree more often than not.

I have asked her if she as a single sister who likes old geezer type doms.

I know that for her almost never agreeing with me she is going to be punished by the great god of punishment, Jim Carey.

He is sexy... I would do him (Carey... either one... lol)

Nosathro -> RE: Executive Orders (1/20/2013 8:05:13 AM)

Speaking of ammo, I came across this little item. If what he does did go nationally, I would say the NRA would be screaming they're taking away law bidding gun owners 2nd Amendment rights. I think this guy is doing a great job, and he from California...

Dear Mr. Vice President,

I am Sheriff Tim Mueller, elected twice by the citizens of Linn County Oregon who have entrusted me with a noble cause: to keep them and their families safe. My deputies and I take that responsibility very seriously and, like you, have sworn to support the Constitution of the United States. I take that oath equally as serious as protecting our citizens. I have worked for the people of Linn County for over 28 years as a member of the Linn County Sheriff's Office as well as serving three years active duty as a Military Police Officer in the US Army, where I also swore a similar oath.

In the wake of the recent criminal events, politicians are attempting to exploit the deaths of innocent victims by advocating for laws that would prevent honest, law abiding Americans from possessing certain firearms and ammunition magazines. We are Americans. We must not allow, nor shall we tolerate, the actions of criminals, no matter how heinous the crimes, to prompt politicians to enact laws that will infringe upon the liberties of responsible citizens who have broken no laws.

Any federal regulation enacted by Congress or by executive order of the President offending the constitutional rights of my citizens shall not be enforced by me or by my deputies, nor will I permit the enforcement of any unconstitutional regulations or orders by federal officers within the borders of Linn County Oregon.

In summary, it is the position of this Sheriff that I refuse to participate, or stand idly by, while my citizens are turned into criminals due to the unconstitutional actions of misguided politicians.

Respectfully,

Sheriff Tim Mueller

Linn County Oregon

“The law presumably says that it is finest to keep as quiet as possible in misfortunes and not be irritated, since the good and bad in such things aren't plain, nor does taking it hard get one anywhere, not are any of the human things worthy of great seriousness.... One must accept the fall of the dice and settle one's affairs accordingly-- in whatever way argument declares would be best. One must not behave like children who have stumbled and who hold on to the hurt place and spend their time in crying out; rather one must always habituate the soul to turn as quickly as possible to curing and setting aright what has fallen and is sick, doing away with lament by medicine.”

In the wake of believed (by him) unConstitutional legislation, there will be civil disobedience on his part. I would much rather see the legislation resisted ,leading to a legal challenge, than have the legislation enforced while the legal challenge wends it's way through the legal system to the SCOTUS. By that time, it would be too late to prevent the damage.

Yet everyone on the right wailed and gnashed their teeth at the perceived (and only perceived in full fledged fantasy) 'violation' of the extremely unconstitutional War Powers Act.

Nosathro -> RE: Executive Orders (1/21/2013 8:44:47 PM)

In the Crito Socrates puts forth various arguments for why it is morally obligatory for him to obey the law. By extension, his reasons can be applied to anyone. I will outline two of these arguments and provide a little commentary on each.

Socrates is talking to Crito (his dialogue partner). Socrates assumes that he and Crito are both citizens of the state.

Question: Do we have a moral obligation to obey the laws of the state?

Argument I. The Argument from Gratitude
P1: The state has provided benefits for its citizens.
P2: We should be grateful to those who provide us benefits (i.e., it is morally obligatory to do so).
P3: We should display our gratitude by obeying the laws of the state.
Therefore, we do have a moral obligation to obey the laws of the State.

Social Contract Argument. More formally, it looks like this.

Argument II. The Social Contract Argument
P1: By not leaving Athens, you’ve agreed to obey the laws.
P2: You should keep those agreements you’ve consensually entered into.
Therefore, you’re obligated to obey the laws of Athens.

As an elected official, he is sworn to obey the law and enforce the law, he can pick and choose which law he will enforce and which he will not.

An the legal challenge will end quickly in favor of the federal goverment. Otherwise, total anarchy would take place within a week in the nation. It'll never hit the US Supreme Court, and if it did, they would rule in favor of the federal goverment. If a county can make a law that superceeds the US Constitution, what stops other counties in the USA from doing the same?

Who said any County was making a law that was superior to the US Constitution? What is being bandied about here is legislation that may or may not be Constitutional for the Federal Government to enact. The Federal Government not being the giver of authorities, but just the receiver of loaned authorities (until which time the US Constitution is declared null, thus ending the Union of the States, returning all authorities and responsibilities back to the proper party(ies)). The Federal Government is not allowed to simply assume more authorities than it has been given. Any legislation written under authorities not granted to the Federal Government would be unConstitutional and should be ignored.

That was the whole point of the Constitution. There were few authorities granted. The Individual and the State were to have a greater impact on day to day life. The Federal Government was for external things and for things between 2 States or among several States. Individuals have the rights and authorities. Governments are created to protect those rights and authorities. Some authority has to be granted to Government in order for them to operate properly, and protect our rights. But, we still retain all rights not granted to Government. Unless we grant Government those rights, they don't have them.

If someone thinks something unConstitutional, then that person should challenge it (provided, of course, that person has standing). Failure to act on an order one thinks unConstitutional may result in one having the consequences of breaking a law, but it can also result in limiting tyranny. The specifics will determine the result. Had Rosa Parks not dared to sit up front, the Civil Rights Movement wouldn't have started right then and there. That we had laws that discriminated is terrible. That we got it right - eventually - is very good. I certainly wish it wouldn't have taken as long as it did, but it did. We have to keep moving forward. We have to accept our failures. Correct them, and keep going forward.

A comparison of the number of our kids the NRA has killed vs the number of our kids Planned Parenthood has killed would sum it up for me.
