Battle's lawsuit states A NOTE WAS POSTED ON THE ASSIGNMENT CLIPBOARD READING "NO AFRICAN AMERICAN NURSE TO TAKE CARE OF BABY," according to the eight-page complaint against the medical center....

Battle said she was working as a registered nurse in Hurley's neonatal intensive care unit Oct. 31, when a man walked into the NICU, where Battle was at an infant's bedside. He reached toward the child, according to the lawsuit filed in Genesee County (Mich.) Circuit Court last month.

"I introduced myself to him. 'Hi, I'm Tonya and I'm taking care of your baby. Can I see your (identification) band?,' " Battle said, referring to the hospital-issued identification used to identify infants' parents. "And he said in return, 'And I need to see your supervisor.' "

Perplexed by his curtness, she asked for the charge nurse, who spoke separately to the man.

When the charge nurse returned, she told Battle that the father didn't want African Americans to care for his child. Further, the charge nurse told Battle that he had rolled up his sleeve to expose what appeared to be a swastika.

"I felt like I froze," Battle said. "I just was really dumbfounded. I couldn't believe that's why he was so angry (and) that's why he was requesting my charge nurse. I think my mouth hit the floor. It was really disbelief."

The charge nurse passed the request to her supervisor, and Battle was reassigned, according to the complaint.

EVEN AFTER HOSPITAL OFFICIALS REMOVED THE SIGN THAT HAD BEEN PLACED FOR A SHORT TIME ON THE ASSIGNMENT CHART, BATTLE AND OTHER BLACK NURSES WERE NOT ASSIGNED TO CARE FOR THE BABY FOR ABOUT A MONTH "BECAUSE OF THEIR RACE," according to the lawsuit. Battle is seeking punitive damages for emotional stress, mental anguish, humiliation and damage to her reputation.

Battle said colleagues have told her they were surprised at the hospital's stand and they have been supportive. But she said she felt the issue was important enough to pursue the matter legally because she expected Hurley to have turned down such a request.

"What flashed in my mind is, 'What's next? A note on the water fountain that says 'No blacks?' Or a note on the bathroom that says 'No blacks'?" she said.

Larry Dubin, a law professor at University of Detroit Mercy School of Law, called the hospital's actions, if true, "morally repugnant."

"The patient's father has the right to select the hospital to treat the child. THE FATHER DOES NOT HAVE THE RIGHT TO EXERCISE CONTROL OVER THE HOSPITAL IN DISCRIMINATION OF ITS EMPLOYEES," he said....

Julie Gafkay, an employment discrimination and civil rights lawyer in Frankenmuth, Mich., who is representing Battle, said "I don't doubt that people have made requests like this in the past. You're not going to control the prejudices and biases of people. THAT'S NOT MY CLIENT'S ISSUE. THE PROBLEM SHE HAS ... IS THAT HER EMPLOYER OF 25 YEARS GRANTED" THE REQUEST. She added: "We made a decision in this country that that kind of discrimination is wrong."


'No black nurses' lawsuit filed against Mich. hospital

I agree with the law professor quoted in the article. Once the parent chooses the hospital, they cannot also choose the specific hospital employees who can or cannot treat their child based on that employee's race.

Of course, some will say that the United States is now a "color-blind society" and we no longer need laws prohibiting racial discrimination. Like the guys in this picture:

Sounds to me like the administrators decided that going along with the man would avoid a much larger scene. Which, when you're talking about the sort of person who will have a swastika permanently inked onto their skin, might easily have been the case.

Also, while I'm not going to argue that the U.S. is colorblind, the existence of a lunatic fringe doesn't really prove any point. Just as vocal doubters don't change the general scientific consensus that global warming is happening, that humans and apes have a common ancestor, or that the earth is round.

ummm.. I am of the impression that when he flashed his swastika tat, that it could have been meant as a threat of some sort.. quite frankly, if I was in the position of being a black nurse I wouldnt want to take care of the baby if it meant my health or life might be at stake..cuz you never know what a nutbar like that might do.. nurses have enough to contend with.. jmo..

You cant force a racist into becoming non-racist.. they have to come to that on their own, some do, some dont..

as distasteful as it may be, it works like this.

the government only has authority over the entities it created.

So it can say that any company or corporation formed under it like a hospital has to hire and use who ever is available, however privately you have the right to discriminate all you want against whom ever or whatever you want.

Its called the freedom to choose.

this whole thread to me glows in the dark with ignorance.

Of course, some will say that the United States is now a "color-blind society" and we no longer need laws prohibiting racial discrimination.

Being a color blind society doesn't necessarily mean that there is no racial discrimination. It could easily mean that the occurrence of it is low. Yes, there are going to be haters of any race, and asshats make up the bulk of them.

Was the hospital put out because of this guy's request? Was it unreasonable for the hospital to have a white nurse on staff at all hours of the day? If not, then, this request may not have been such a ridiculous accommodation.

Guess the customer isn't always right...

And, before any of you jump on my for supporting this guy's request, I don't agree with his decision, but I do think he had the right to make it, and the hospital had the option to grant it. If it made the hospital's provision of service more difficult, I could see charging the guy more.

Im going to chime in and focus on this part of your post, DS. Im not singling you out... just using it as a reference.

Newborn Nursery isnt always sunshine and rainbows. Real problems occur. A well staffed hospital will ensure the majority of their NBN staff are NALS certified...neonatal advanced life support... its the baby version of ACLS.

Not all hospitals are extremely well staffed. Not all hospitals will have a "diverse" range of ethnicity on all shifts.

Anyone seeing the problem yet? Allowing a this sort of prejudice wont just fulfill a racists wet dream... which I could care less about. Its the patient that will suffer.

And what would happen in the case of a code? Does the hospital still follow the parents wishes? What about the staff? What if the trained people are all of the race not allowed to take care of that infant who are the only one's trained to deal with the crisis?

How fast would they sue if they lost their baby because a black nurse refused to treat their child based upon the parents' demands.. simply because the parents demanded they not do so?

How quickly would the nurse lose her license? The ANA would bust her ass faster than any other entity.

This is bad business, bad policy and bad legal sense.

It is the (IMO bogus) argument presented by some conservative Whites that, since the American voters elected a half Black man President twice, we can now repeal all anti-racial discrimination laws and end all affirmative action policies & programs.

I remember when I was a kid in the early 1960's hearing some Southern politician saying, "since we let 1 of our 1,000 N**gers vote, there is no need for any Voter's Rights law."

This happened at my workplace once.

The gentleman became vulgar and rude when his black aide entered the room, and demanded a "white woman".

I offered him a box to pack his things in, and he quickly changed his tune. I did not have the staff to accommodate his request, and have low tolerance for situations which impede the efficiency of my assignment.

Charge more? This isnt about money on that end. And what insurance company will cover that extra charge? In order to accommodate his request, the hospital now has to amend their chedule to aldo include racial as well as the knowledge base?

So we now have to racially profile the nursing staff, respiratory therapy, lab, house keeping, dietary... this isnt just about the nursing staff.

Which (*cough*) at the very least violates an equal protections clause, constitutionally, and since the hospital and insurance company undoubtably engage in interstate commerce.............

And now a teaching hospital is facing one because someone would rather kiss ass then actually do their job. Legal should have been called about this request long before it was made "policy" and placed on the chart. Note that the article later states the "note" was removed, however, the staffing remained in place per the parent's demand.
