on a profile if you know some 1 is using photos of porn star from the chek claiming to be them and are now a uk citizen from X area . WHAT do you report that as . as i coudlnt see any thing fitting

To the best of my knowledge, the only way to do so is via this form : http://www.collarme.com/personals/stolen.htm

BUT that is for the person in the photo and/or the person who owns the rights to the photo. Although it is very likely they've just downloaded a picture from a porn site there isn't any way for you to demonstrate they aren't using it with permission, unless you are the owner.

Just report the photo or profile.

If in doubt.... use the 'Scammer' option as I was told to.
It is not reviewed by anyone - it's done automatically by 'bots on the site.
Just report it and move on.

ah thanks .. guess i should just block them and ingore them its a shame as i feel there should be a report button .. have to say i fell for the act for a while was only due to some lonely friday night i found out

OP,

Only the owner or person with the rights to a photo can file a DMCA take down notice, even with CollarMe. This is to ensure that it's not abused or photos / videos not taken down when the person using them has the right to use them.


You can however, notify the owner of the photo via email that their picture is being used and attach a link. I've personally had people stumble across my vidcaps or videos and do that for me.

If it's an explicit primary photo, flag it for that reason.

Otherwise, simply hide the profile.

There is a report photo button. Use that and someone in site support will look at the photo.

That's all that needs to be said, really. We're all (supposed) to be adults here. Caveat Emptor should be the word of the day whenever you're on a site like this. Early on, I jumped on that bandwagon, but now, I could care less if someone gets fleeced because they're stupid. About the only reason I care anymore is for the amusement value to me. Yeah, I'll report an obvious 'bot, but otherwise, I let it be now.

I have thought this many times coming across various threads like this so now I will ask. Why do you care? Is it your photo that was stolen? If not then what difference does it make, it's just a picture. This is the internet and sometimes people lie, but who cares.

I don't know how true this is, since only the copy right holder or their agents can legally file a DMCA notice. Now ignoring a DMCA notice is another story, the copy right holder can choose to take legal action.

Sometimes, the modding on here and the other side are truly fucked up and unjustified.

I am not a mod.
I do deal with DMCA stuff daily.

ONLY the copy right holder or their agents can file a DMCA take down notice. Even then you have to proof you are the copy right holder.

Example: If you see a a video with me on xhamster YOU can't send them an email to take it down.

Someone who is NOT the copy right holder reporting "stolen" pictures to a volunteer staff bogs down the staff so that they can't deal with issues such as illegal subject matter in emails or TOS violations.

Again IF you want to do something for a copy right holder, shoot them an email with links to where you found their photos or videos and if they feel inclined to file a DMCA notice they can / will.

Question, what if you see a picture of me on say fetlife. On someone else's profile and you hit the report button and say it's a stolen picture. However, that person actually had MY permission to post it. That is why for someone to say a picture is stolen and it be removed, you have to file a DMCA notice and proof you are the copy right holder.

You saying someone doesn't have a right to use a picture doesn't make it so.

You reporting "stolen" pictures that aren't yours bogs down the volunteers on this site.

ETA: I recall in another thread awhile back the Mods explaining to you why you got the gold letter. Did they not?

ETA: The scenario is exactly as the OP is saying.
They don't own the copyright but they know for certain they are in breach of ToS.

Which only the copy right holder can do.

It's not only a DMCA issue if there is a water mark or a site name on the picture or video. I simply have to proof it's mine.

Again, YOU are not the copy right owner of the pictures. YOU have no real knowledge of who has a right to use those pictures or who doesn't. So YOU reporting them as stolen may or may not be true and is bogging down the volunteer Mods.

IMO it is YOU who may be violating the right of others by making false accusations.

Let me try another example:
If you have a car and one day you loan it out.
However, a neighbor who thinks he is being helpful. Sees someone other than you getting into your car and driving off with it and they report the car stolen.

To ME that isn't much different than what you are doing.

The one and only "explanation" they gave was 'capricious use of the system'.
The system is there to be used and we are encouraged to use it.
So why chastise someone for doing precisely that??

Ok. So you go to the website where the pic is "owned" by the webmasters or site owners.
It clearly states that all pictures and photos and artwork is copyright to the site.
That's pretty damned obvious to me and anyone else with half a brain cell.

So.... anyone using a pic from the site isn't legally able to - not even those that submitted the original pic/photo/artwork in the first place.
And no, we aren't refering to just one site or even a few dozen.
I'm saying that there are literally thousands upon thousands of stolen images used on the other side in profiles.
Surely it's everyone's duty as a site member to report such incidents?
The proof is on the website they came from. It doesn't take a rocket scientist to see it.

If there is any doubt whatsoever, the mods should check and if necessary, check with the members using the images in question. Just shooting the messenger and leaving (at best) questionable images is not the right thing to do.

Again... just because a site states that the pictures or material are owned by Joe Blow Productions. Doesn't mean Joe Blow Productions didn't give Sally Cums A lot permission to use the picture(s).

You are simply assuming that the person posting them doesn't have a right to use them. However, YOU can't make that claim since you are not the copy right holder or owner of the picture(s).

Again, if a copy right holder wants to have a picture taken down due to someone violating their copy rights. The OWNER or THEIR AGENT has to file a DMCA notice. Some random person can not do that. Again, even when a copy right holder files a DMCA notice they have to show PROOF that they own the picture or video.

You are asking the volunteers of this site (Mods) to enforce a non-existent DMCA notice. Why should they do that?

If YOU or anyone is concerned about someone else's pictures being used here or any where. YOU contact the copy right owner via email stating you found their picture(s) and or videos and again IF they want them removed. Trust me they will thank you and file the DMCA notice.

ETA: I am by no means defending those who steal pictures but there is a process and it is there for a reason. It is far to easy for folks to make allegations that are false, even in this matter.
