2009... prom... drunk girl after she leaves school dance... 20 people watched... 10 people participated... she remembers very little... found by police on school property after a campus security sweep post dance didnt find her (no, they were not looking for her, no one informed them this was happening just outside)...

The blessing in all this... she remembers very very little.

http://www.dailymail.co.uk/news/article-2335716/Trial-begins-horror-assault-girl-16-gang-raped-20-men-left-dead-homecoming-dance.html

One of the original stories....

http://abcnews.go.com/WN/charged-richmond-california-homecoming-gang-rape/story?id=8935918#.UbC0dNLVDv5

2 have pled guilty for reduced sentences.

I have issues with the defense attorney's "beliefs" about how his client's dna ended up on a used condom found at the scene. But, its an attempt at a defense.

This mirrors the Ohio rape charge with people watching and taking photos.

One watcher answered the girl's cell phone, spoke to her father, and told the man just how good his daughter was.

I really dont hold out much hope for this generation.

Why do they get reduced sentences? I don't get how that works, really.

Depends what the definition of "is" is? Any angle is available for some lawyers.

I hope this shit goes viral and starts a revival of personal responsibility and morality. Picture takers and gawkers should be rewarded with harsh sentences. That fucker that talked to her father should really get raked over the coals.

It's a damn shame that this shit happens. Damn.

It is what we taught them and continue to teach them. It is the society we have built and we continue to make it worse for them on a daily basis.

Apparently the school paid the victim for lack of security.

Outside court, Cope explained that the victim had sanctioned the plea deal.

Doesnt seem enough, to be honest.

From the OP:
    quote:

2 have pled guilty for reduced sentences.

The article says that 2 have reached plea deals and are already serving their sentences.

"Pleading Guilty" does not imply agreeing to testify against the others. Agreeing to "plea deals" could include that, depending on the deal.

The State can haul their sorry carcasses from the pen to testify.
I'm not saying that's happening,just giving a possible reason for a plea.

We arent teaching them personal responsibility. We have taught them that they dont have to respect law or rules.

Look at the "role models" we give them. Hollywood? DC? We point to people like Obama and call him honorable (despite the fact that very independent review sites clearly indicate he both bends the truth and breaks it completely). Bush? Yeah... Bush lied and killed a few hundred thousand people and impoverished the US but there are probably statues of him somewhere. I shudder to think what message that sends.

A guilty plea will keep the girl from going through the trial.... it also saves the state money for the trial.. it saves the guilty from an even longer jail term...and I truly doubt they got the deal without agreeing to testify against the others.

The girl agreed to the plea deal.

Im all for sparing her any humiliation and further trauma. 32 years is a long time.

We dont have to point that far. Many parents admit to raising their children to "take no shit from anyone!" Kids have "friends" as parents these days... not parents. How many youtube videos have you seen where kids are fighting and the parents are urging them on.

We have always had bad politicians... we now have bad parents. And this is the result of parents insisting their children " do no wrong".

It is, but I don't think it's enough. I wonder when they'll be eligible for parole.

I agree... sort of. Yes we have. The world is never black & white. But we've reached a place of lawlessness in the high ends of our society that is sort of ridiculous. Don't get me wrong, I agree with the personal responsibility angle also -- both for the kids and the parents. I just wish that people would consider the implications of our elections beyond the obvious one of "my team won/lost". We have become a corrupt society.

Being eligible doesnt mean they will be granted.

quote:

Unless the court specified a minimum time for you to serve or imposed an "indeterminate" type of sentence, parole eligibility occurs upon completion of one-third of your term. If you are serving a life sentence or a term or terms of 30 years or more you become eligible for parole after 10 years. If the court used sub-paragraph (b) (2) of §4205, Title 18, U.S.C. in your case, you are eligible for parole at any time.

Seems to me even a life sentence would have him eligible after 10 years.

There is always that "no possibility for parole" clause, no?

Would you turn on someone with that clause, knowing that if you go to trial and get a life sentence, you will be eligible for parole in 10 years?

I find it despicable that kids would engage in this behavior. I find it that reprehensible, that I can't fathom how parole being available is justice. I can't understand how justice can be served - which I'm certain we agree needs to happen - by reducing a sentence because someone has plead guilty, even if they have agreed to testify against the rest. How can it be that those kids can't be subpoenaed for their testimonies, deal or no deal?

Because it spares the victim. Imagine not being able to remember and hearing the many trials over this case where some may say she begged for it..some may talk about how eager she was.. some may discuss how the blows happened.. some may discuss how she begged for more....

His crime when he comes up for parole will be taken into consideration. Its the best situation for the girl.. and he is off the streets for at least 10 years.

I'm sorry. I forgot to say that I understand that it shields her from at least some of the horrors she'll have to go through.

I can not state on the boards what should be done to the people who committed the act and those that watched, to do so would be promoting a criminal act.
