You assume a fact not in evidence; to wit: that Trayvon would not have inflicted fatal, crippling, or permanently debilitating injuries.

Okay. Good point on the word "panicking" unless you can put the idea into the minds of the jury that a reasonable man might have panicked. If a man beating the crap out of me goes for my gun... yeah, panic seems reasonable.

truckinslave -> RE: Zimmerman Trial - LIVE (6/29/2013 11:16:15 PM)

I agree, DS, but there has been all this dreck about Zimmerman being the aggressor, and I don't think that passes the smell test.

Racism? After taking on the town PD on behalf of a black homeless stranger?
A violent streak?
After years of carrying a gun, of being on neighborhood watch, he just suddenly decided he wanted to kill someone, and Trayvon was handy?

ah well,.. you very conveniently forget to mention the time he beat up his girlfriend and she got a restraining order against him.. and the time he hit or pushed a woman when he was a part-time security guard for parties (& he got fired/let go).. oh yeah, and the time he attacked an uncover cop who was trying to arrest an underage friend of his who was drinking.. and he also harassed a co-worker at one job he had

and the fact that he was on various meds so would at times get aggressive and nutty.. and yet he either didnt tell them that when he applied for a gun permit or maybe in FL its ok if you are a nutbar on meds and wanna carry a gun.. [8|]

DK, I am not an attorney, but...
I have never heard of a case in WV where a defendant was not allowed to plead self-defense. Perhaps someone some time killed a sleeping man with a high-powered rifle at 300 yards and was so denied.

quote:

Also if there is a struggle over a weapon then the shooting isn't self defense

Someone attacks me, tries to take my weapon, and ends up dead, and it's not self defense?? Seriously? To me, and I believe to everyone I've ever talked to about armed self-defense, that's a no-brainer and we're back to Stinson:

That the attacker sustained a mortal wound is a matter that should have been considered by the deceased before he committed himself to the task he undertook.

I was the trainer for probably a thousand CCW applicants; to all of us, try to take my weapon at your own mortal peril.

Let me be sure I understand this.
Anyone in Texas can pull a gun on anyone who is walking in the same direction they are, providing said person is behind them, and they tell the person they are holding them for LEO.
You cannot be serious.

truckinslave -> RE: Zimmerman Trial - LIVE (6/29/2013 11:39:30 PM)

Okay. If you believe that justifies a leap to the idea that he just "wanted to kill that boy", then that's what you believe.
But I believe that's a helluva leap
My mind just doesn't go there, cannot project it

DaddySatyr -> RE: Zimmerman Trial - LIVE (6/29/2013 11:49:24 PM)

I think it's sadly ironic that in Sep. 2012, the case was clearly about race but after Miss Jeantel testified that "creepy-ass, white, kill-my-neighbor, cracker" wasn't a racist term, the lawyer for Trayvon's parents called a little presser to make sure that the world knew the case wasn't about race.

I don't know, it's starting to look like it was about race; just not the way the bleeding hearts who were originally on the "innocent black kid killed by a white [sic] guy" band wagon wanted it to be.

Trayvon wasn't going to have no "creepy-ass, white, kill-my-neighbor, cracker" following him. He wasn't going to tolerate that. He was going to do something about it, even after Jeantel told him not to (she holds as much authority over Trayvon as the police dispatcher held over Zimmerman and her "order" was much clearer).

In my very first post about this subject, I called Zimmerman a "cowboy". It is starting to look like I was very wrong. I think a young thug was trying to get himself some street cred and picked the wrong "crazy-ass (actually not white) cracker".

No one is turning cartwheels over this but there are far too many that wanted to convict Zimmerman because a black teen was killed. I even saw a website that insisted that when a black youth kills a black youth it's based in racism. Huh? Wha?

Peace and comfort,

Michael

I never said I thought he wanted to kill the kid, but I do disagree strongly that Zimmy doesnt have a violent streak.. those incidents show he does.. and the things he said to the 911 dispatcher show he was upset cuz they "always get away".. Regardless of Zimmy denying he tried to hold or grab Martin to hold him for the cops, it is my opinion that is exactly what he did, which would be when Martin smacked him in the face and Zimmy fell backwards.. That is how I believe it went down.. and yeah, I believe OJ killed 2 people also.. OJ got away with it, we will see if Zimmy does or not..

I try to base my opinions on facts.
I haven't seen anything even alleged that supports that opinion.

One more thing that bothers me, and it is not about the case itself, but the jury.

6 women? why not 12 jurors on this trial?

An eyewitness to the 'attack on a cop' thing said that what George actually did was simply put his hand on his shoulder and ask what's going on.
And the restraining order thing was mutual, with the whole thing getting dismissed.

State law.
Nothing magical about 12

Florida uses 6 jurors except in capital cases.
The jury is a big win for the defense too, money well spent on one of the top jury consultants.

the facts dont exist at this point.. there is no proof either way.. and I dont believe Zimmy, his word/claims imo are not actual facts & are biased due to the situation he finds himself in & him not wanting to go to jail.. The jury does not have the luxury of having facts on who started the physical altercation, but they will have to decide regardless.. I am not on the jury so I have my own opinions on what happened..

I somehow doubt that Zimmy only put his hand on the cops shoulder, there wouldnt have been the original charge/arrest otherwise.. and this report lists the original charges.. sounds like Zimmy was drunk (& perhaps beligerant as drunks tend to be) at the time too.. and the girlfriend filed first, he counterfiled in an attempt to diminish hers.. I bet she is glad she never married the guy.. [:D]

"In 2005, Zimmerman, then 20, was arrested and charged with “resisting officer with violence” and “battery of law enforcement officer,” both which are third-degree felonies. The charge was reduced to “resisting officer without violence” and then waived when he entered an alcohol education program. Contemporaneous accounts indicate he shoved an officer who was questioning a friend for alleged underage drinking at an Orange County bar."

So, if my opinion is that 0bama0 asked Zimmerman to kill Trayvon as part of a scheme to start race riots he could use as a way to impose martial law and Zimmerman agreed provided 0bama0 would make him Czar of Florida and Potentate of All He Surveyed, well, that's cool, because after all it's just my opinion, it's not like I'm just making up shit or anything, right?

LeesaLove -> RE: Zimmerman Trial - LIVE (6/30/2013 12:38:13 AM)

If it is a state case, there only needs to be 12 when the death penalty is on the board, in Florida.

I feel sorry for the jury.

All of the six members are women. Five are white, one is Hispanic. The four alternates include two women and two men, all of whom are white, but for one male Hispanic.

And they are asked to try a racially charged case. Doesnt matter which was this case goes, they will have a hard time afterwards.

One of the questions asked during the jury selection is as follows....

De la Rionda also asked if the potential jurors had been members of a neighborhood watch group and if it was acceptable for individuals to take the law into their own hands. None of the jurors had much experience with neighborhood watch groups and for the most part didn't believe it was OK for individuals to act as law enforcement officers.

"There may be occasions, but I would generally say no," said a middle-aged black man.

Many seem to believe this jury is the best possible jury Z could have gotten. To be honest, Im not so sure.
