Oh, that's to be expected. They probably already had the appeal paperwork ready to go days ago. No surprise there.

Prosecution can't appeal double jeopardy.

Not on the murder charge, but they may try to re-charge him with something else? I don't know, I'm not a lawyer, obviously.

They can't. A jurisdiction gets only one try. It is possible he could face a federal charge but that seems unlikely.

That I knew. I was speculating that they may try to re-charge him with something else, unless the Feds jump in.

The state can't. A jurisdiction only gets one trial for one event. they can't keep bringing you back into court on different charges till they get one to stick.

That makes sense. Betcha the Feds already have papers drawn up though. But they'll probably wait until they need another red herring before they file them.

I truly am relieved at the verdict, however as said before there are truly no winners.
I pray for this young mans family and I pray that Zimmerman can eventually find peace.

He won't, unfortunately. His life as he knew it ended over a year ago. But all the thug supporters assume Martin is the only one who lost his life that night.

We will soon see Zimmerman making the rounds of the right wing gun nuttia fringe speaking circuit. He is certain to make a fortune from confirming to all the very afraid gun nuts that they definitely positively should be prepared to shoot any scary young black men they see at the slightest provocation.

I point it out for the same reason that I point out that Medgar Evers was a black man...

But you've already been counted once, no double dipping.

Shit if I know..... its all Powergamz can point out... brown skin man... like that is some special attribute... like other races dont have brown skin... like its supposed to give the fucking moron the license to be as racist as he wants to be...

You racist! How dare you berate me because I am not white! Just because I am Native American doesnt give you the right to belittle and demean me, you fucking pig!

Powergamz1 -> RE: UNMODERATED ZIMMERMAN (7/13/2013 8:33:30 PM)

You know, that's an excellent point, and I won't say you are wrong.

For myself, I'm not happy with the fight fire with fire approach... but nothing else works.

In the case of the new form of Racism 2.0, David Duke, Don Black and the rest sat down and worked out a meme that festers if not confronted directly and harshly... and 'wins' if argued with reasonably and politely.

After putting up with hearing racist 'logic' since I was a little kid, 60 years on, I'm in no mood to be polite... A character flaw I'm sure.

Did you not notice the thread title? The regular rules around here work to the advantage of the racists and their R2.0 games, because calling them out is considered 'insulting'.

They on the other hand, get away with 'camel jockey' 'fuking illegals' and 'boy' all the time.

But feel free to explain what's pretty about all that kind of hateful language.

ORIGINAL: Rawni

quote:

ORIGINAL: Powergamz1

I must admit that I'm a flawed enough human to get a certain satisfaction from knowing that a lot of covert racists are having heartburn over a brown skinned man being allowed the due process that they would demand for themselves.

Let's see how many out themselves here tonight. I've seen 2 so far.

You are being very ugly.

There is nothing pretty about it, but you don't have to join them to combat them do you? There are people that enjoy political discussion, that won't set foot down here because of the bull shit that is allowed. You could make a point without the things you say and so could some of them. Then, I am the wrong one for thinking free thinking adults would act like adults.

I seriously doubt that. Zimmerman's life ended a year ago too. I know that doesn't support your argument, but it's true.

All this incident teaches gun owners is they can no longer defend themselves without being called homicidal racists. First they couldn't speak their opinions without being called racist, now they can't defend themselves.

It's a sad day when people support a thug more than a man just defending himself.

The nightmares sadly, will live forever on both sides.
Tragic to say the least.

Well said.

For those who are applauding the Zimmerman verdict, a teenage boy is still dead.

For those who are angry at the verdict, public opinion is a bigger court, and sometimes far harsher, than our criminal sentences.

I am applauding the verdict simply because it shows that the judicial system works like it is supposed to. The evidence was extremely weak. Under our judicial system, Zimmerman was innocent until the evidence convicted him, and it didn't do that. The fact that so many people could come up with wildly different scenarios, all supported by the evidence, shows just how weak it was.

The part that DOES bother me is how crappy a witness Rachel Jeantel was. The prosecution was obviously too incompetent to adequately prep her.

I really doubt he'll face federal charges.

They used civil rights law to go after Klansmen who got off in state court back in the 60's and after the very troubling acquittals in the Rodney King beating case but otherwise that sort of prosecution is rare. I really can't see any grounds here for a civil rights case.

And while I vehemently disagree with the verdict there is no evidence that the prosecution didn't try or that the jury ignored the law. Florida has a screwed up self defense law and precedents but that is not really a federal concern.

The thug was the wannabe who called 911 for an open garage door and violated every precept of the NW program. Martin was a teen and his behavior does not seem particularly unusual for a teen.

And I guarantee Zimmerman will soon be making speaking appearances in favor of CCW and spreading Florida's insane stupid self defense standards to the rest of the nation.

I see no reason to applaud or to be angry. The system worked as intended.

Now the wrongful death suit will be filed.

Ahh so after a year and a half, we're back on the NW thing hmm? So you want a person to ignore something that looks suspicious instead of attempting to help his fellow neighbors?

That's not a world I want to live in. I know when I was in middle school and my neighbor caught someone breaking into my house, I was very grateful as his help led the cops right to the people who did it.

I dont think so, not unless Zimmy gets some money from somewhere.. its possible that a suit would be filed.. i am just not sure what the point would be.. and perhaps the family doesnt have the stomach for it at this point..

I don't have the link (saw it on FARK), but there will be no suit. And with that, good night. Hopefully no one starts a riot, here or anywhere else.

Luckily for Zimmerman, he isn't OJ. Can't get blood from a turnip.

tazzygirl -> RE: UNMODERATED ZIMMERMAN (7/13/2013 8:47:05 PM)

Because a suit can be placed against future earnings, if any. Its not about the money.

This is how bizarre Florida is on the matter. In the rest of the nation, and in other countries that base their laws on English common law, a claim of self defense is an affirmative defense and the burden is on the defendant although at a lower standard of proof than beyond a reasonable doubt. In Florida a self defense claim has to be disproven by the prosecution beyond a reasonable doubt which is a nearly impossible standard as this case demonstrates.
