The U.S. Supreme Court declined Monday to take up an appeal of a lower-court ruling that struck down Virginia’s anti-sodomy law, halting state Attorney General Ken Cuccinelli II’s long-standing legal efforts to preserve the statute.

Cuccinelli is the Republican nominee for governor on the Nov. 5 ballot, and Virginia’s “crimes against nature” law — which bans oral and anal sex — has become a flash point in his contest against businessman Terry McAuliffe (D), who has portrayed Cuccinelli as an extremist on social issues.

Amid a government shutdown, looming default, economic woes, crises around the world, and God knows what else, it's good to know Cuccinelli is taking on our biggest problem of all--"crimes against nature." I wonder how many taxpayer dollars he spent on this crusade.

According to Cuccinelli, but according to him this is necessary to stop child predators (??????)

Correct me if I'm wrong, but does Virginia NOT currently have laws that prohibit statutory rape and/or oral/anal sex with child (??????)

And if that is the real issue and Virginia lacks a way to go after child predators shouldn't the Virginia legislature enact some appropriate legislation designed to protect the specific issue necessary instead of some outdated overbroad law that, as currently written, applies to all consenting adults engaging in the same activities.

Sorry to say, but there is no reasonable conclusion to draw from this other than that Cuccinelli is both homophobic and leads an incredibly dull sex life, not to mention wasting our tax dollars. A real life loser in more ways than one can count.

My understanding is that laws concerning sex with minors (statutory rape) are federal. States don't need them. That said, the age of consent does vary by state.

This article shows Cuccinelli running as far away from Cruz as he can, while McAuliffe tries to link them. In Virginia, federal employees carry a lot of weight, and they can't be happy about the shutdown.

The states have their own child sodomy laws that are fully enforceable after the Supreme Court ruling in Lawrence, which was very careful to spell out 'consenting adults in private' as a condition.

I can't imagine how he thinks he's going to get elected for governor. I mean, this is the guy that's fighting to make it a felony to get a blowjob. If he was running in, like, Saudi Arabia he might have a shot, but not in Virginia.

Good thing this was struck down. Otherwise, the state's tourism slogan would have to be changed from

"Virginia is for lovers"

to

"Virginia is only for lovers who practice genital intercourse exclusively."

Not exactly the same commercial appeal.

And now I'm wondering if this wasn't Cuccinelli's veiled attempt to ban sex between gay partners?

He may have been was publicly calling it an attempt to stop child predators, but maybe he had other intentions because if oral and anal sexual contact became illegal, it would pretty much take away the ability of gay men to engage in sexual activity.

Of course it was. He didn't even try very hard to convince anyone otherwise. The law he claimed was solely to protect against pedophiles never once mentions the age of the partners as a relevant factor and Virginia already has anti pedophilia laws.

The case he cited as reason for the law was a case of consensual oral sex between a 47 year old and a 17 year old (age of consent in Virginia is 15). So to actually address the problem the thing to do would be to change the age of consent in Virginia not outlaw all oral and anal sexual contact.
