A federal judge has found that the state of Texas cannot require an abortion provider have admitting privileges at a nearby hospital (one of the many so called TRAP laws meant to force abortion providers to shut down).

Texas will of course appeal which is a good thing since the higher up the appellate process it goes the more states will be covered by this ruling.

FR where I normally wouldn't reply at all, because the topic has already been posted.

Going strictly off the news story, without any commentary that may be in the OP, this is what I keep trying to tell those who live and vote in terror of the fundy wing. It ain't going to fly.

Chill out, and quit knee-jerk defaulting to the side where the authoritarian streak isn't already prohibited by the Constitution.

Of course. Everyone should vote for the Republican crazies so they can appoint yet more right wing judges till Roe v Wade is overturned. It makes perfect sense for supporters of abortion rights to do that, NOT!

AUSTIN, Texas — A federal appeals court judge is considering whether to grant an emergency appeal that would allow the state to enforce a law that could shut down a dozen abortion clinics in Texas.

In court papers filed with the 5th Circuit Court of Appeals, Texas Attorney General Greg Abbott asked the judge to make a decision by the end of the day Tuesday. Clinic operators have said a third of their facilities will have to stop providing abortions if the law takes effect.

District Judge Lee Yeakel ruled Monday that a requirement that doctors have admitting privileges at a hospital within 30 miles of an abortion clinic does nothing to protect women's health.

Abortion doctors have had difficulty getting such privileges since hospitals have different standards.
yay for small government...

When I saw the thread title, this provision came to my mind as the one which was probably found unconstitutional:

Roe vs Wade has been challenged time and time again. So I doubt it will be overturned. The Supreme Court by history has overturn it self very few times. Now think of the Texas taxpayers paying for all this, and they don't have the money to pave their roads.

thing is it isnt just texas, and while RVS may NOT be in serious jeopardy of being overturned by the SCOTUS, it is being chipped away by various methods, including tightening rules about facilities, doctors, and personhood law, over 1500 attempted laws have been brought in since 2012 and more are coming...and too many women are getting fucked over during the time of a bill passing and bills being thrown out.

A panel of judges at the 5th Circuit Court of Appeals issued a ruling Thursday evening, three days after District Judge Lee Yeakel said one provision serves no medical purpose.

The panel says that the law requiring doctors to have admitting privileges at a nearby hospital can take effect while a lawsuit moves forward.

The Texas attorney general's office argued that the law is a constitutional use of the Legislature's authority.

Lawyers for Planned Parenthood and other abortion providers had argued that the regulations did not protect women and would shut down a third of the abortion clinics in Texas.

If the law is Constitutional, then there is no legal reason for it to be deleted.

Now, I do understand that just because a law is Constitutional doesn't mean it should be passed.

...and it is a bad year for the left, Obamacare fails, MSNBC has to eat it's words tonight (delish) when Texas succeeds in getting it's laws reinstated and the restrictions on New York police by a leftist judge who steered this case to his court are overturned also. Next up, Benghazi witnesses will be allowed to, well, witness.

And if they had had a reason to impeach Bush they would have done it when he was president. But that didn't and doesn't stop some on the left from still bitching about it long after he was gone. I had one guy in the store the other day claiming that if we had impeached Bush when he was in his first term, people would not be losing insurance today due to the ACA. Not sure how the logic works in that one, but he was sure convinced it was true.
