Status: offline 		A dog owner is suing the police for a million dollars for killing his dog.

What I don't understand:

Why were the officers cleared of any wrong doing when they didn't even shoot the dog until after it was restrained?

Since the offers were close enough to the dog to have it restrained in a catch pole, why did they shoot the dog 5 times? Did they want the dog to feel every bullet, to make the death as painful as possible? Can officers actually make it through police training if they can't shoot better than that at close range?

There isn't enough information in the article to even guess at how the officers were cleared of wrongdoing.

I'm thinking $1M is too high for damages, even if the guy wins his case.

I doubt he will get that amount, but I am guessing that its that high because the real purpose of it is to get police department to rethink their policies in regard to officers killing pets. With a million dollars riding, the department at least has to give greater consideration to what happened.

Killing the now controlled dog is irrational. The only thing that gets government's attention is money.

Pretty much impossible to fire people. So people kill dogs, eat donuts, sleep on the job with impunity.

So the guy goes to court. Win's his million bucks. City insurance pays. Mayor scolds the Police chief. Police chief makes noise - says he's going to fix things.

Nothing changes.

Overpaid police donate to police chief. Donate to Mayor.

And the only people that lose are the taxpayers.

Status: offline 		About 6 months ago as I was walking down the street, a " “territorial and aggressive” dog " attacked me, biting my leg (the bruise is still visible and not healing/disappearing, not to mention the pain it caused).. it ran 200 feet to attack me for no reason (now what damage would it have done had I been a little kid???)..

If an owner doesn't want his dog put down or killed by the cops, the solution is up to the owner & its quite simple.. keep the dog in your house/secured yard..

Status: offline 		I can appreciate where you are coming from regarding aggressive dogs, and the need for people to keep them appropriately controlled, TJ. There are areas in this valley where I would not go for a walk without a firearm, just because of the dogpacks. We had a poor woman literally ripped apart by a pack of pitbulls about six months (they called her a jogger in the news reports, but she was just a 63 year old who took a daily walk).

That does not, however, justify or excuse the habit and common practice of law enforcement shooting any dog they don't like the look of, without even a report to be filed on doing so.

Someone reported this aggressive dog (obviously after having some sort of run in with it), that took time to do, it took time for the cops to be sent out, it took time for them to find the dog.. where was this concerned owner while all this was going on? the problem with these dogs is their owners don't take laws & responsibility seriously.. and we don't know exactly what happened to the person that called in about the dog, it could have attacked/chased him/her.. there was a reason why that person was compelled to call.. from the vid, the garage door was wide open, a cop went to the door.. so seems that either the owner wasn't there or was hiding from the cops.. the dog is big & strong as it also looks like the one cop (even with the hoop around it) was not able to control this dog so imo, the dog fighting it and pulling the cop around is why it was shot, not cuz they didn't like the look of it.. If the cops had left the dog and it went on to hurt someone, then of course everyone would be bitching cuz they should have taken the dog in.. the cops can't win in this case.. (& I am not usually a defender of cops but I don't have much sympathy for the dog owner who created/allowed this situation to occur).. as I said, all the dog owner had to do was keep his (aggressive) dog in his house..

You should get that looked at by a wound specialist. Nothing should take that long to heal. Are you a diabetic by any chance?

Status: offline 		Just a thought. Commerce City is one of the run down areas of Denver. When I read "Commerce City" and "pit bull", I thought drugs. I don't know if the cops were biased because of that, but they may have been.

That said, killing a dog that is not a threat is ridiculous.

Sentimental value isn't a basis for damages. I read a case back in law school (the class was called "Remedies," and we were studying exactly what sort of damages you could claim on various sorts of cases, and how to compute those) where a woman's dog was killed in, I believe, a car accident, and she sued the driver of the car, claiming a large amount of money for the dog based on the dog's sentimental value. The court sympathized with her loss, but decided that there was no way anybody could ever offer proof of the sentimental value of an animal or good, and so disallowed the damages awarded by the jury. She ended up with a couple hundred dollars for the dog, which was the cost of purchasing a dog of the same breed.

I absolutely agree that police, in general, are out of control when it comes to shooting dogs. I don't know about this case, as I don't have access to the police report to know what the officers state is their reasoning.

the outside broken skin has healed, its the bruise mark under the skin that hasn't.. it has faded but its still there, almost like its a scar (but not one).. not diabetic that I know of.. it doesn't hurt or anything, and its not that big.. just I don't like seeing it..

I got stung by a spotted ray once. The stinger was the size of a 2penny nail, embeded deep. Had a discoloration at the wound for near 25 years. There is still a slight void there.

That kind of venom kills flesh, doesn't it? I've heard that it can leave a 'pit' where the dead flesh never re-grows.

It regrows, very very slowly. Took over 25 years. The wound is no longer visible, the pit barely perceptable.

Status: offline 		Having faced a few drug protection dogs in my day and not being a believer in animals being more important (or even as important) as people, I can't help but to believe that if I don't know the dog and he shows any agression, I wouldn't even give him the benefit of the restraint noose.

Having said that, while the one officer/agent is trying to hold the animal in the contraption, he is unable to safely use his weapon in self-defense. He's "neutralized".

Since I don't subscribe to an animal's life being near as important as a human life ... an un-known animal that shows aggression deserves what they get.
