9th Circuit Ruling

The fact that the 9th has been a bastion of left-leaning thought for a long time had me scratching my head and looking for other links to support this story.

I caught the story about 30 minutes ago on FOX Nuuuuuzzze. Not only that but Wyoming approved concealed carry for school teachers with permits.

Let the blood bath begin.........not Wyoming and California, the CM P&R forum.

As usual I was right on target

Now, when are they going to rule that a 155mm Howitzer is constitutional ? I want a cannon for my birthday or maybe a tank.

Which radicals in the 9th circuit for which nutsackers on the Supreme Court?  Lets get down to cases here.

But we have to discuss actual law as well.

Maybe if we disqualify anyone from serving on any court if they have engaged in extremist activity
..... like reading the Constitution.

Well....the Constitution doesn't specify muskets, revolvers, automatics, Howitzers, or nuclear warheads. Personally I won't be happy until we can all have our own nuclear warhead. Just don't give one to my neighbor....he drinks too much.

You would have to flush 5 nutsackers off the SCOTUS before any dealing was done for anything else, that puts you at great disadvantage.

What ruled is that since the 2nd is an individual right they can ban open carry
or they can have may issue as opposed to shall issue concealed carry permits, but they can't do both.

Do you even realize I'm not taking this seriously? The whole thread is rather silly to begin with. Satyr doesn't like how some court in the country ruled on something. Cry me a river. He doesn't like how the 9th circuit court ruled? Fine, he can have his view but first, we have to remove the Heller vs. District of Columbia outcome. Deal?

The point is, that judges have the right to rule as they believe the laws should best be understood, NOT, but popular decree! It is the hope those judges rule in favor of the best argument without any bias.

Sure, you can have your nuke but I would use something like a .50 caliber machine gun on the dog. Save the nuke for DC.

Actually, the 18th century notion of the 2nd amendment held that the only element of the text concerning the individual was their good standing with the militia they were a part of. "....The right to bear arms..." was concerning the individual to have their arms in their home or business. An were considered separate arms from any other arms they might have own (a rifle for the militia and one for hunting). The belief was that those arms would be better kept safe from an enemy attack on the town in the homes of individuals in good standing with their "...well regulated militia...". Rather than in an arsenal which the enemy could destroy in the middle of the night and place the town in great peril. An that those arms of the individual in the militia are used for a specific purpose, "....being necessary to the security of a free state...". They didn't have to deal with the modern era problems that firearms hold to lawmakers in the 18th century. Or I suspect they would have added in a line or two spelling out the individuals right to self defense on an individual level.

Ignoring the first half of that amendment and re-interpreting the second half as you want is a very unwise idea. Consider ignoring the first two thirds of the 8th amendment and re-interpreting the remainder. What sort of problems would come about?

We can go back and forth on this. So I will give you a counter proposal. How about the 28th amendment as a sort of 'update' of the 2nd amendment in the modern era of America? I'm sure you can understand quite well that such a notion is not to be screwed around with lightly, right? An that it involves a serious understanding of not just the logistics but the wisdom to handle concepts, ideas and technology years after we are gone from this Earth. Something that keeps the government in check, yet does not create more problems for our fellow Americans. Hopefully a middle ground approach on a very heated debate.

It was 2-1, from a 3 judge panel, and IIRC, there are 28 judges total on the 9th Circuit. It seems it would be pretty easy for this to go into the "blind squirrels getting a nut" file.

We now have conflicting ruling from different cicuit courts on restrictions of concealed carry, so the issue will be off to the Supremes I'm sure.

I think the current structure in California places far too much discretion in the hands of the county sheriffs. Where I live, it's basically fill out the form, pass the livescan background check, and pay the fees. In LA County, it's fill out the form and wait 18 months to be told to go fuck yourself. That may change, now that their sheriff has retired in disgrace, but the system could be much better.
