Nah, I made that mistake once... I changed the tshirt, when I realised why I was getting nasty looks.....im really not that petty to wish harm on anyone I just "disagree" with.

The Union Flag is the flag for the UK, we call it the Union Jack, altho its only meant to be the "union jack" on a ship

Yep. We agree. We all have pride of place and ancestry that identifies us. If you return to the OP you will note this thread is about a court case that evolved when 'American' students wore shirts to taunt and object to a school sponsored day of pride for Mexican Americans. IMO, the nativists were wrong. The Court sided with the school administrators.

If you read the news account I posted in #31 you will find that the confrontations occurred the year before, that the Cinco de Mayo event was sponsored by the school for its predominantly Mexican American students, and that the nativist student minority had protested by chanting "USA, USA." Taunting, without doubt. The action by the school was taken to head off trouble in the following year. Try to keep up with the story.

And under the circumstance Eugene Volokh is full of crap. But no surprise given his already biased views:

He advocates campus speech rights and religious freedom, and opposes racial preferences, having worked as a legal advisor to California's Proposition 209 campaign. He is a critic of what he sees as the overly broad operation of American workplace harassment laws, including those relating to sexual harassment.

It is well established Constitutional case law that school authorities have a duty to maintain a well ordered learning environment that supersedes students' free speech.

Flag code...

I remember having to learn the flag code and proper ceremony for burning a worn out flag for a merit badge in the Boy Scouts of America. This thread has me looking it up again to refresh my memory.

A lapel pin is considered a "replica" of the flag and considered appropriate for apparel. Flag patches on uniforms are allowed by the flag code. In the 1960s precedent was set that a "replica" of a U.S. flag printed on a shirt was not in violation of the flag code.

Although there are no criminal penalties in statute for violating the flag code; violation of the flag code were included in indictments of Vietnam war protesters, probably with the intent of eliciting a higher likelihood of conviction and harsher sentencing. I remember having to learn the flag code and proper ceremony for burning a worn out flag for a merit badge in the Boy Scouts of America.

Things that were considered a violation of the flag code:
Wearing a flag draped about the shoulders as a garment.
Throwing a flag on the ground and stomping on it while changing, "Hell no, we won't go"
Displaying the flag and pelting it with garbage.

That is very true. But it is not well established Constitutional case law that people who turn violent when they perceive themselves "taunted" should be rewarded by restricting everybody else's Free Speech rights. How do you feel about cartoons? Blasphemy laws?

As I said, Cinco De Mayo isn't celebrated nationwide in Mexico. Just one little town.

It is celebrated in just about every town with a Mexican American population in the US. Like Mardi Gras and St Patrick's Day, it is a use to get shit faced drunk and party like no one gives a shit.

Then along comes a school in overly politically correct California that decides to have a celebration during the class day.

Everyone knows how egotistical the average Texan is about Texas Independence, but you dont see schools setting up a celebration for Texan Independence Day, and it aint because they are afraid of pissing someone off or hurting someone's feelings. It is because school is for two things, football and academics.

And in no story did I see that these students wore shirts with the American flag on them to cause trouble.

I agree with K, these students need to grow the fuck up, and the Administrator that told the boys to turn the shirts inside out or go home should have his ass handed to him and sent packing.

As for the Judge, he needs off the bench, or put in pet court in Amador City CA.
