It comes down to what would be considered excessive force. What would cause you to perceive the attacker as such a clear and present danger that turning them into person pate that requires a scoop shovel to put into a body bag was the best option? I would suppose that if the fellow was wearing a hockey mask, armed with a fourteen inch chef's knife, and was wearing a name tag reading "Jason" it might be obvious. Otherwise, how are you going to convince a prosecutor or jury that pate was your best option?

Actually everyone acknowledges that is what the shooter and no one else says. Funny how shooting for com has the effect of leaving fewer witnesses. So where is your proof there were no warnings? There is none, the police and the prosecutor both accept that there were, but you know better. Most of us didn't care what you wanted to use to do something stupid. So once again you think you know more than the experts, more than the people who were there, more than the people who saw the actual evidence. Big surprise.
