Beyond your bizarre conspiracy tin-foil nuttiness...

The Supreme Court struck down just three of his recess appointments to the National Labor Relations Board as unconstitutional, and did not go as far as some conservatives hoped to undercut the president’s ability to fill vacant executive branch posts and judicial slots.

The court ruled hte appointments were unconstitutional because the Senate was not truly in recess when he made them during a three-day break in pro forma meetings of the Senate.

So essentially, he just has to wait for when they are truly in recess, then appoint away as he chooses.

The Senate's real option is to do their job and fill vacancies instead of tying them up over multiple other issues.

WHAT personal attack?

Not only is the response totally on your point, it even uses your link as evidence.

You already know, but ignore, that I'm not a fan of Bush Lite. But Cheney did his best to strengthen the presidency (and I warned at the time this as a dangerous precedent, regardless of party), and Bush Lite is taking advantage.

And, other than three appointments, "the imperial president" as you call him (fair enough -- I referred to King George III) is getting his way.

Bush Lite is a disappointment, but there's a trend going back to Cheney. It will be worse with the next president, whomever that turns out to be.

Sanity's racist crap aside this ruling is problematic.

The Senate did not stay in session to thwart the President. The House refused to recess and the Senate cannot recess if the House is in session (Article 1 section 5 of the Constitution).

So a hostile House can in theory prevent recess appointments from ever happening. Add in the glacial pace at which things get done in the Senate and the sheer number of people that are required to have Senate approval for their jobs and it becomes impossible to get all those positions filled if the opposition party chooses to not cooperate.
