Does the Constitution not apply to Barack Obama, or did I miss an amendment somewhere along the line that gives the President the power to declare war?

Will the same answers be in play when a Republican is elected to the White House, and has to wage the war President Obama decided to start, and has said will be going on for years?

Well if congress wants their say on this business with ISIS, they can quit their childish games, man up, and do the dirty. Otherwise they have no call to complain if President Obama deals with a threat to national security by executive order, since the rest of the government is effectively defunct.

Has Congress authorized him to use the military against ISIS? He can start use of the military, but needs to have Congressional approval to continue it past 90 days.

Well, that's according to the War Powers Act. But, I don't think he has the authority to send the military in according to the War Powers Act because the requirements haven't been met.

According to a 1995 article in the American Journal of International Law, "Presidents and their advisers point to more than two hundred incidents in which Presidents have used force abroad without first obtaining congressional approval."

So it would appear that once again you have both feet in your mouth and your head up your ass.
