We have elected dead people (literally) for Congress -- they couldn't serve, but still got elected, so that the governor could appoint someone to the post.

And, the converse isn't necessarily true. Just because someone is ineligible to run doesn't necessarily make him (so far) ineligible to serve. But, let's not let the actual wording of the Constitution, including it's amendments, get in the way.

But he would be assuming an office that he is ineligible to be elected to ?
That's just insane and would,I believe,constitute a constitutional crisis .

As the 22nd Amendment (and 12th, for that matter) is written, there is nothing limiting the number of years a person can serve as President; just a limit on how often a person is eligible to be elected.

well, except for that two year thing. So, if a guy is elected prez, he dies Jan 22 of the year, that means the VP would take over for the balance of the slightly less than four years, he then could only run and be elected once.

Eligibility for Vice President of the United States

The Twelfth Amendment states that "no person constitutionally ineligible to the office of President shall be eligible to that of Vice President of the United States."[21] Thus, to serve as Vice President, an individual must:

Be a natural-born U.S. citizen;
Be at least 35 years old
Have resided in the U.S. at least 14 years.[22]

Disqualifications

Additionally, Section 3 of the Fourteenth Amendment denies eligibility for any federal office to anyone who, having sworn an oath to support the United States Constitution, later has rebelled against the United States. This disqualification, originally aimed at former supporters of the Confederacy, may be removed by a two-thirds vote of each house of the Congress.

Under the Twenty-second Amendment, the President of the United States may not be elected to more than two terms. However, there is no similar such limitation as to how many times one can be elected Vice President. Scholars disagree whether a former President barred from election to the Presidency is also ineligible to be elected Vice President, as suggested by the Twelfth Amendment.[23][24] The issue has never been tested in practice.

Also, Article I, Section 3, Clause 7 allows the Senate, upon voting to remove an impeached federal official from office, to disqualify that official from holding any federal office.

There hasn't been a situation where a former President has attempted to run as a VP. I'm not sure if there has even been a situation (after FDR) where a former President has run for and been elected to Congress.

I remember chatter at one point (1980 perhaps?) about Ford's possibly running as Reagan's VP, but that never panned out. Tbh, it's hard to imagine anyone's wanting to be VP after having occupied the Oval Office.

John Quincy Adam is the only President I can think of who later served in Congress. Tyler may have served in the Confederate legislature. Taft went on to become Chief Justice--the job he'd actually wanted all along.

And it isn't relevant because Ford was ok to run in76.
I believe that Andrew Johnson also served in Congress after being President.

His Wikipedia entry says he served in the Senate, only former President to do so. I don't think I ever knew that. Thanks!

ETA: It must have been quite an experience to become a member of a body that came within a single vote of ousting him from the Presidency.

He ran repeatedly after the presidency -- three times? Finally got in by a single vote...and was generally ignored.

He's obviously not the "only" president to do so--as you noted earlier, John Quincy Adams served for years after his presidency.

The way I remember it (and I was young but, I looked it up, at the time), because Ford served less than two years of Tricky Dick's term, he could have been elected to two full terms of his own. I can't swear to this but, I'd be willing to bet ... oh ... 50¢.

Well, Ford's share of the term was August 9, 1974 – January 20, 1977....almost 2 1/2 years of it.

But yes on the rest...my recollection as well.
