To me it doesn't matter who does it (DOJ or some local prosecutor), if a crime was committed then it should be both investigated and prosecuted as appropriate. If those that are tasked to enforce our laws fail to do so, then I believe that society will collapse into anarchy. If I violate a law, I would confess. No problem. I once left a safe full of classified information unlocked and went home. Pure oversight on my part, guilty as charged. I started an investigation into the act. The punishment could have been anything from non-judicial to 10 years and $10k. Because I was honest about it, I got the former punishment and it was determined that no leak occurred (I have no clue how they did that). The point is, you do the crime, you do the time - whatever that is.
