The OP follows suit with all the unarmed black kids being blasted by cops.

As an FYI side note, if I remember correctly Eddie is an x sheriff and these guys really raise hell down in texas but it shows the level of bs a person must go through to win a case against these road nazis and the extortionist courts.

People cannot be compelled by statute or ordinance to surrender a right in order to exercise a privilege.

FYI: This is how people can turn these situations around though its extremely difficult.

and she wound up dead for that.

thats not anything that would warrant arrest.

I have Eddie on in the background as a refresher since these guys understand precisely the fine lines and tricks used and if you go to the 19 mark he talks about search.

It appears like the cop also violated her due process rights with an illegal search.

If you all listen to the video I posted it will demonstrate how the government has become an instrument of extortion.

The cop has been put on a administrative duty, for not following department procedures during a traffic stop.

CD I read somewhere earlier, that she lane changed because the cop had done a u turn to follow her and she pulled over to let him pass......
I wont say thats a positive n i cant find the right link.but now the unglitched ahem vid has been shown, it might be on there.

I told all of my children when they were growing up that when a police officer gives you a lawful order, whether you agree with it or not, just do as your told and, if he acted inappropriately, we'll sue his balls off, later.

The police officer, saying: "Put out your cigarette, please." is a lawful order. Sure it seems a bit paranoid but I can flick a cigarette twenty feet, if there's no wind. Imagine one hitting you in the face (or eye). It is a reasonable precaution.

Once she refused the first lawful order, he was well within bounds to ask her to step out of the car. She, then, balked at that.

If I had been the officer, I would have immediately called for a supervisor, at that point because of the "some people can do any fucking thing they want" attitude that pervades this once-great nation.

Cops want to go home to their families, at night and "Put out your cigarette, please." is not an outrageous request.

All of that said, there is no evidence what-so-ever that anything other than a suicide happened in that jail cell. Can we wait until a little more evidence is in before we start building gallows?

watch the video I posted, if you do exactly as you are told the officer who becomes the plaintiff in the case will set them up in a manner in which they have no defense in court. That is what they are trained to do. Not protect the people but extort money from them.

That woman was smart in that she knew her rights and tried to retain and invoke them to the best of her ability despite one needs to be a supreme court judge to know how to do so. 'properly'

In the video I posted, and craig is from texas btw, he points out the fine lines involved in these traffic cases. It would be a lawful order had the officer already placed her under arrest but if I remember correctly he demanded she put it out prior to placing her under arrest. Its not that the request is outrageous, its that it is not a lawful request until she is made aware that she is about to be placed under arrest.

I was surprised that msnbc actually sided with the girl, bravo for them.

So ... a lawful order can only come after one is under arrest or after one is told what it is they're being arrested for?

That kind of sheds a new perspective on lights and sirens ...

Technically, when a cop hits the cherries and and siren, you are being "arrested". When you get a traffic ticket, consider it a "desk appearance ticket".

So, this young lady was, indeed, under arrest. She just wasn't in custody.

have been reading through the thread and was just going to add this anyway, but its also somewhat consistent with your post above jv---I caught a few minutes of this story last night on the Kelly file and they were talking about mental illness in relation to it...

Some years ago, we had an epidemic of black deaths in custody. Usually it involved a black person being found dead after an arrest and incarceration for a summary offence, just like the Bland case. On a number of occasions there were strong suspicions of police involvement in the deaths, such as this case. However the resulting trials ended in the (usually) all white juries returning verdicts of not guilty. In 1990, after some 150 black deaths in custody, a Royal Commission on Black Deaths in Custody was established and it returned a number of recommendations, some of which have been put into practice and the remainder ignored. Blacks are still dying in custody here in numbers far greater than pro rata, though in lesser numbers than was the case before the Royal Commission.

So it would appear that black deaths in custody are an issue common to both the US and Australia. IOW racism is rife in certain law enforcement circles in both countries. It mystifies me that some people are agitating for removing some of the few protections that minorities enjoy (eg affirmative action programs, anti-Discrimination legislation ....) while there is such clear evidence of ongoing racism in State institutions. Especially so when such racism can lead to lethal outcomes.

Surely incidents such as the OP underline the ongoing need for such legal protections. As blacks are still dying in custody, if anything, these legal protections ought to be strengthened not removed.

I think the problem is that this society allows too much leeway to cops. They're allowed far too much "discretionary" power which makes these kinds of abuses possible. Maybe they should be under some sort of time limit when they make a traffic stop, which would force them to remain on task, write the fucking ticket, and stop trying to make inane conversation and asking whether someone is "irritated." If they go over the time limit, then the cops should have to let the person go and pay the fine themselves.

They don't need to ask if someone is irritated to write a traffic citation, and he also didn't need to ask her to put out her cigarette while she was in her own car. If he didn't like the smoke, then he could have stepped back to write the ticket. At this point, since the advent of traffic cams, all they really need to do is get the license plate and mail the ticket. The whole idea of a "traffic stop" is rapidly becoming outdated anyway. It's not essential for traffic enforcement. It's only used as a psychological ploy and a mind game, as indicated by the police officer's behavior in the video. He's clearly engaging in a mind fuck, and that sort of behavior should not be allowed in our public servants.

Why does this have to be a black thing ? This same type of shit happens to all races. I see it as an out of control Nazi cop thuggery thing. I'm a white guy and cops scare the crap out of me too because you never know what kind of cop personality it is that's stopping you. Any level headed person knows it's best to be polite with a law enforcement interaction during a traffic stop. Had she been polite she wouldn't have gotten into that mess though I hope this particular Nazi cop gets what he deserves.

One thing to keep in mind for those with smart phones is there are applications that stream live video to an off site server. They're fast to turn on and your device can be rigged up to aim at the drivers side window. There are even some people who rig their vehicles with camera all around to stream live video. YouTube has examples of this and examples of some phone apps too. YouTube also has some videos on how best to conduct yourself during a traffic stop as to usually avoid negative consequences such as in Sandra's case.
