The outcome of an investigation should not be prejudged while FBI agents are still hard at work trying to gather the facts," the letter, signed by Chairman Chuck Grassley and Committee member Lindsey Graham states. "Conclusion first, fact-gathering second—that’s no way to run an investigation. The FBI should be held to a higher standard than that, especially in a matter of such great public interest and controversy."

"It is unclear whether the FBI agents actually investigating the case were aware that Mr. Comey had already decided on the investigation’s outcome while their work was ongoing. However, it appears that the answer to that question may be underneath some of the extensive redactions that the Department made to the transcripts," the letter continues.

According to the letter and an ongoing investigation into the matter, Comey started drafting a statement exonerating Clinton in April or May of 2016. At this point, he had not interviewed Clinton herself or her closest aides. This included Bryan Pagliano, who set up the personal server where Clinton hosted and shared top secret information, and Chief of Staff Cheryl Mills, who was granted immunity. On July 5, 2016, Comey made his public statement that the FBI would not be referring Clinton to the Department of Justice for prosecution.

i think that's close to what I am suggesting; that since she has not been found "guilty" in a court of law, to the comrades she's therefore innocent but to many of the rest of us, she is indeed not innocent.

I do agree however with your observation of their "not being able to see beyond their side."

the townhall article (oh no comrades!) is the first ive seen of the story.

Clinton, the Democratic presidential nominee in 2016, was investigated by the FBI for using a private email address and server to handle classified information while serving as secretary of state.

In July 2016, then-FBI Director James Comey famously called Clinton’s email arrangement “extremely careless” though he decided against recommending criminal charges.

Though Clinton lost the election, Clevenger is still attempting to obtain documents related to the investigation. He's seeking to prove she committed perjury, the Washington Times reported.

He specifically asked for all documents resulting from a September 6, 2016 referral to the Justice Department from then-House Oversight Chairman Jason Chaffetz, a Utah Republican.

At the time, Chaffetz asked the department to “investigate and determine whether Secretary Clinton or her employees and contractors violated statues that prohibit destruction of records, obstruction of congressional inquiries, and concealment or cover up of evidence material to a congressional investigation.”

On Aug. 8, the FBI asked Clevenger to detail why the public would be interested.

“If you seek disclosure of any existing records on this basis, you must demonstrate that the public interest in disclosure outweighs personal privacy interests,” the letter stated. “In this regard, you must show that the public interest sought is a significant one, and that the requested information is likely to advance that interest.”

Clevenger expressed disbelief at the request.

“Frankly, I am stunned I should have to explain why my request pertains to a matter of public interest,” Clevenger wrote in an Aug. 11 letter to the FBI.

He cited how Clinton was the Democratic nominee for president of the United States, a former secretary of state and a former senator.

Clinton used a private email server during her tenure as secretary of state. It was a scandal of epic proportions for the 2016 Democratic presidential candidate, considering her decision could have placed our national security at risk.

She didn't see it that way though. Asked repeatedly about her unsecure email server, she offered glib answers and insisted Americans didn't care about the story.

In her new book, "What Happened," she again blamed the media for costing her the election with their obsession over Russia. She also blamed Comey, who reopened the email probe just 11 days before the election.

“After reviewing the document in camera, the court concludes that it largely rehashes information already made public, thus obviating any need for secrecy,” the judge said.

Keeping in line with the State Department’s legal position under President Barack Obama, Trump administration officials are also opposing the case filed by the conservative watchdog group, Judicial Watch, seeking records regarding Hillary Clinton’s emails. Earlier this week, U.S. District Judge James Boasberg ruled in Judicial Watch’s favor ordering that most of a FBI declaration detailing the State Department’s efforts to retrieve Hillary Clinton’s government emails be submitted un-redacted.

In the spring, Trump administration officials with the State Department filed a motion to dismiss the Freedom of Information Act case. They aren’t refusing to cooperate with the requests for emails but rather contend that no additional recoverable federal emails exist.

Chad Readler, the Acting Assistant Attorney General hired under Trump, filed a motion on June 23, 2017 in which he contends that declarations submitted by the FBI prove that State Departments and the FBI were through and exhaustive and they have no reason to believe additional unrecovered email records exist. Most of the searches referenced in the court paperwork refer to efforts done by both agencies prior to Trump taking office.

“We’re happy with the ruling but it is unbelievable we’re being opposed by Trump appointees in the State and Justice Department’s on the Clinton email issue,” said Tom Fitton, president of Judicial Watch, in a statement obtained by LawNewz.com. ” President Trump ought to be outraged his appointees are protecting Hillary Clinton. The State Department should initiate action with the Justice Department – and both agencies should finally take the necessary steps to recover all the government emails Hillary Clinton unlawfully removed.”

Judicial Watch is specifically seeking emails sent by Secretary of State Hillary Clinton on two blackberry accounts during her first weeks in office. To prove “its good-faith” recovery efforts, the Secretary of State’s attorneys submitted two FBI declarations — one in secret (or in camera and ex parte). Judicial Watch opposed the secrecy and demanded that the court order the declaration re-submitted for all to see. The non profit group won on that point, and the rest of the case remains ongoing. The case was originally filed by Judicial Watch and Cause of Action Institute in 2015 when President Obama was in office.
