"FBI Finally Admits It Has a Bunch of Documents About Bill Clinton's Tarmac Meeting With Loretta Lynch"

Government watchdog Judicial Watch has been pursuing the documents for months and will receive them at the end of November after issuing a Freedom of Information Act lawsuit against the Bureau. The lawsuit was filed after the Bureau refused to turn them over earlier this year.

"The FBI originally informed Judicial Watch they did not locate any records related to the tarmac meeting. However, in a related case, the Justice Department located emails in which Justice Department officials communicated with the FBI and wrote that they had communicated with the FBI," Judicial Watch found. "As a result, by letter dated August 10, 2017, from the FBI stated, 'Upon further review, we subsequently determined potentially responsive documents may exist. As a result, your [FOIA] request has been reopened.'"

Under Attorney General Jeff Sessions, the Justice Department has refused to release unredacted internal talking points developed in response to the meeting. The meeting took place just days before then FBI Director James Comey announced he would not refer Democrat presidential candidate Hillary Clinton to DOJ for prosecution. Lynch had previously asked him to call the FBI's criminal investigation of Clinton a simple "matter."

Comey said during congressional testimony earlier this year the Lynch/Clinton meeting prompted him to be "unusually transparent" about the Bureau's criminal investigation of Hillary Clinton. Lynch also admitted the meeting was improper, but maintains the only topics discussed with the former President were grandchildren and golf.

“The FBI is out of control. It is stunning that the FBI ‘found’ these Clinton-Lynch tarmac records only after we caught the agency hiding them in another lawsuit,” Judicial Watch President Tom Fitton said in a statement. “Judicial Watch will continue to press for answers about the FBI’s document games in court. In the meantime, the FBI should stop the stonewall and release these new records immediately.”

Unfortunately the drafts are completely redacted, but take note of the date: May 2, 2016.


As shown by the FBI's tweet, the final statement about the case was delivered on July 5, 2016 but was being drafted in May. This was two months before Comey made the official announcement that Clinton would not be referred to the Department of Justice for criminal prosecution. It was also before Comey had interviewed nearly a dozen key witnesses in the case, including Clinton herself. Clinton was interviewed on July 2, 2016 for just under four hours.

The release of the drafts backs up the assertion from Senate Judiciary Chairman Chuck Grassley that Comey decided long before FBI investigators were done with the case that Clinton would not face charges.

"According to the unredacted portions of the transcripts, it appears that in April or early May of 2016, Mr. Comey had already decided he would issue a statement exonerating Secretary Clinton. That was long before FBI agents finished their work. Mr. Comey even circulated an early draft statement to select members of senior FBI leadership. The outcome of an investigation should not be prejudged while FBI agents are still hard at work trying to gather the facts," Grassley and Committee member Lindsey Graham wrote in a letter to FBI Director Christopher Wray last month.

"Conclusion first, fact-gathering second—that’s no way to run an investigation. The FBI should be held to a higher standard than that, especially in a matter of such great public interest and controversy," the letter continued. "It is unclear whether the FBI agents actually investigating the case were aware that Mr. Comey had already decided on the investigation’s outcome while their work was ongoing. However, it appears that the answer to that question may be underneath some of the extensive redactions that the Department made to the transcripts."

Shortly after this revelation, Graham said he "smelled a rat" and demanded Comey return to Capitol Hill to explain previous and conflicting testimony about the case.

“This doesn’t add up, and I smell a rat here,” Graham told Fox News. "He needs to come back to the Committee."

Gowdy told Baier the timeline of events surrounding the email investigation did not seem to add up, noting that Comey told Congress during his June testimony that it was the tarmac meeting between former President Bill Clinton’s and former Attorney General Loretta Lynch that helped convince him to announce his findings in the email investigation.

“His ostensible reason for taking that decision away from the Department of Justice was that meeting on the tarmac but yet a month and a half earlier he is memorializing a decision he’s already made so the chronology does not add up,” Gowdy said. “His answers have been all over the map.”

"Decisions made by the Department of Justice in 2016 have led to a host of outstanding questions that must be answered."

The Committees will investigate the following:

-FBI's decision to publicly announce the investigation into Secretary Clinton's handling of classified information but not to publicly announce the investigation into campaign associates of then-candidate Donald Trump;

-FBI's decision to notify Congress by formal letter of the status of the investigation both in October and November of 2016;

-FBI's decision to appropriate full decision making in respect to charging or not charging Secretary Clinton to the -FBI rather than the DOJ; and

-FBI's timeline in respect to charging decisions.

"The Committees will review these decisions and others to better understand the reasoning behind how certain conclusions were drawn. Congress has a constitutional duty to preserve the integrity of our justice system by ensuring transparency and accountability of actions taken," the statement continues.

The Department of Justice and FBI have come under extra scrutiny in recent months after it was revealed former FBI Director James Comey drafted a letter exonerating Clinton long before agents were finished with their investigation. The letter was also drafted before Clinton and her top aides were interviewed for the case.

Comey was fired in May after Deputy Attorney General Rod Rosenstein concluded he had usurped his authority by publicly announcing Clinton's exoneration.
