That's actually what should have happened. Or been impeached. That's what we do in this country to people who can't/won't do the job they've been hired to do.

I agree that takes time and would be wasteful. Still, that's the procedure we have in place for elected officials who aren't willing to do their job. And rightfully so. After all, we're talking about basically vacating an election. It SHOULDN'T be an easy process. In any event, is it any more wasteful than incarcerating her AND paying her salary?

This should be in interesting court case. I can see the play now; the clerk invokes the "right of refusal" in the workplace because it would endanger her immortal soul.

Is it your legal opinion that the court had no juridsdiction and that she is in jail illegally?

One would think that the math of that problem would be pretty simple for a third grader. Isn't she drawing her salary in both instances?

The election has not been vacated. She is still the clerk and she is still drawing her pay. Any time she would like to do the job she was hired to do she can go back to work.

No. I think the court has jurisdiction and is legally holding her for contempt. I question the wisdom of it, not the legality of it. There are other options available to the court that solve the marriage license problem that don't involve turning Davis into a political prisoner/prisoner of conscience. As things stand now, the court has turned her into something of a martyr... basically the gay rights movement is doing the political equivalent of shoving their marriage license up her ass. The intelligent thing to do is find a solution to the problem without appearing to be bullies.

Yes, she is drawing her salary in both instances. The problem is she was duly elected to this position. Removing her from it means following the correct legal procedure. Ie: impeachment, or whatever the procedure is in Kentucky. If you don't, you no longer get to use the 'but she's not following the law!' argument, because now you're not following it either. A judge can't just vacate an election. Thank Goodness.

In short, if you want her gone, the removal process needs to start regardless of the cost or efficiency of it. Keeping her in jail only adds to that cost.

There are, however, other less drastic options that solve the problem without locking someone up. For example, change the marriage licensing laws so that her name comes off of it, and any of her deputy clerks can sign the license. That might be as simple as an executive order from the Governor.

Or my personal favorite: de-regulate marriage entirely and just have the government treat everyone as an individual. No more civil marriage.

ETA: If memory serves, the attorneys for the couples denied licenses specifically requested that she not be jailed. The judge disagreed, saying that fines would likely be paid by her lawyers and supporters rather than Davis herself.

That would in fact be vacating the election. If you change the job description of what she was elected to do that is in effect vacating the election.

They've been doing that since she was jailed, but Davis's lawyers and husband (he of the "Welcome to Sodom and Gomorrah" sign) argue that those licenses are invalid.

That makes me wonder: Is this really about her conscience (which could, after all, have been satisfied by the far less dire step of resigning) or is it about preventing any marriage licenses for same-sex couples in Rowan County?
