There are, however, other less drastic options that solve the problem without locking someone up. For example, change the marriage licensing laws so that her name comes off of it, and any of her deputy clerks can sign the license. That might be as simple as an executive order from the Governor.

That would in fact be vacating the election. If you change the job description of what she was elected to do that is in effect vacating the election.

I'm sure you actually believe that, too.

There are other options available to the court that solve the marriage license problem that don't involve turning Davis into a political prisoner/prisoner of conscience.

Such as . . . ?

quote:

basically the gay rights movement is doing the political equivalent of shoving their marriage license up her ass.

Oh my.

ETA: If memory serves, the attorneys for the couples denied licenses specifically requested that she not be jailed. The judge disagreed, saying that fines would likely be paid by her lawyers and supporters rather than Davis herself.

Look through this thread and tell me the gay rights movement isn't thrilled she's in jail.

Who on the thread is the voice of "the gay rights movement"? So far as I know I'm the only LGBT poster.

And why reduce the whole world to a single CM thread anyway?

JVoV -> RE: An now jailed! (9/6/2015 8:22:59 PM)

I'm actually still disappointed that all of this has had to come about through the judiciary.

But Governor George Wallace at least had sense enough to stand down.

I probably represent the G. The BLTs are on their own.

No actually you are not the only LGBT poster as JV has pointed out. And while I am in no way a voice of "the gay rights movement" I have no problem with them locking her up. If they had only fined her she would have raised the money online and it would not have taught her anything. This way she is the one who gets punished. And while I doubt she will learn much it might make others think twice before they pull the same bullshit.

I require avocado on my BLT.

PeonForHer -> RE: An now jailed! (9/7/2015 10:42:48 AM)

Myself, I'm fine with LGBTs. It's just BLTs I consider an offence to all that's human and natural. God should strike down anyone who sullies the holiness of bacon with lettuce and tomato.

Thegunnysez -> RE: An now jailed! (9/7/2015 10:51:18 AM)

"Don't Sully the Holliness of Bacon" Perhaps the name for a nich fast food outlet. Test cities could be Bagdad.Damascus and Riyadh

Mayonnaise is underrepresented in the BLT community. It doesn't even get acronyminated.

But I'm gonna need you to put a shirt on before you speak of bacon again.

I don't wear a shirt, JVoV: I go to work wearing only my army-surplus boots, a thong and a bow tie. I'm *British*.

Where is your bowler and your bromly lad? A gentleman simply does not go about without the proper accoutrement. While we are about it just how does one wear surplus-army boots without spats?

How much?

thompsonx -> RE: An now jailed! (9/7/2015 4:54:20 PM)

I think you might be able to make a few quid here mate

The election has not been vacated. She is still the clerk and she is still drawing her pay. Any time she would like to do the job she was hired to do she can go back to work.

Really? I'd have thought that wouldn't automatically expunge the 'contempt' charge.

The contempt thing is open ended. She can terminate her incarceration any time she agrees to do her job. Having been found in contempt of court is no big deal. It usually involves a fine. Remember the "oj" case where ito kept fining people for their phones going off?

Given her lawyers, I am not sure she is getting unbiased advice.
