As the evening went on, the author notes, it was clear that Customs and Border Protection officials were defying a judge's ruling.

Good question, but I guess you'll have to ask Obama.
Under the Act, travelers in the following categories are no longer eligible to travel or be admitted to the United States under the VWP:

Nationals of VWP countries who have been present in Iraq, Syria, or countries listed under specified designation lists (currently including Iran and Sudan) at any time on or after March 1, 2011 (with limited government/military exceptions).

Nationals of VWP countries who have been present in Iraq, Syria, Iran, Sudan, at any time on or after March 1, 2011 (with limited government/military exceptions).
Source: Visa Waiver Program Improvement and Terrorist Travel Prevention Act FAQ

The act was updated in February of 2016 to include Libya, Somalia, and Yemen (here).

Well i think the point is, even Obama, for whatever reason felt the need to limit/control the entering of people who have been in this list of countries for whatever reason. They may not be telling us everything but obviously something is triggering this list. Just because someone who has the bomb strapped on them to commit terrorism doesn't mean the operation isn't being controlled from someone else. We don't know what we don't know... but it seems even Obama agreed there was something to be very concerned about.

From now on, I'll be making a monthly donation to the ACLU.

Neither party nor the administration has a clue. We're left with courts and the Constitution.

I wonder why the boots on the ground would defy an Obama-appointed judge, and side with the Trump administration...

As of Sunday morning . . .

The US Customs and Border Protection Agency at Dulles International Airport has refused to grant attorneys access to any detainees it may be holding, according to Sharifa Abassi, who is coordinating the volunteer lawyer efforts underway there. Yesterday, a federal judge for the Eastern District of Virginia ordered respondents, who include CBP, President Trump, and the CBP Port Director for Dulles Wayne Biondi, to “permit lawyers access to all legal permanent residents being detained at Dulles International Airport.”

Abassi says late Sunday morning a border agent told lawyers that agents have been instructed not to speak with them. About 15 lawyers have been directed to call Steve Sapp, an official with the CBP Office of Public Affairs, but have so far have not had their calls answered or returned. Washingtonian called the number, which directed reporters to a cellphone number whose voicemail was full.

Abbasi and one other lawyer we spoke to say officials at Dulles have refused to engage with the lawyers since this morning. A border agent who agreed to bring the lawyers’ request for access to detainees, as well as a copy of the order, to her supervisor came back with this message: “It’s not going to happen.”

Emphases mine.

LEGAL residents are protected under the law. See meaning of legal. It pertains to law.

If Bannon's puppet doesn't want to uphold the law, he should resign.

Actually, according to international treaties, foreign nationals have full protection under the law, UNLESS proven to be agents of a foreign government, i.e spies.

Which is why, when a foreign national is detained or arrested, the local consulate is contacted and a representative of their foreign affairs department is sent to the holding facility.

The US Government expects such treatment of Americans in other countries, and we give it in return.

Furthermore, the executive order as written and signed by President Trump is not only unconstitutional, but it violates agreements long established on refugees as well as foreign nationals visiting the US, which basically states that unless we can prove them to be 'undesirables' as detailed in those agreements, they must be allowed into the country, at least as far as a facility that can house them comfortably until such time as any necessary investigation can be completed.

Now, if you are comfortable with American Citizens being detained in an airport somewhere....

In other words, we are bound by international law to treat those people the same as our people are treated by the local authorities.

In case you have not been paying attention, Trump's orders have created a diplomatic shit storm with Muslim and Non-Muslim countries alike.

Militarily, the US could piss off one or two second rate military powers, but right now, we are pissing off everybody, including those that could hold their own against our military.

MrRodgers -> RE: ACLU blocks common-sense terrorism control (1/29/2017 2:02:28 PM)

You begin to see how easy it is in this 'land of the law' [sic] as the right (repubs and their ilk) can obey a federal court order to break up families and deport mom or dad or both when they choose to act in compliance of a federal order but they favor officers of the law when they disobey a federal court order to detain travelers or people, in violation when they choose to in direct contempt of a federal court.

I've been telling you kinkroids, the dems are corrupt but the right and the repubs in this country give a whole new meaning to the coming RIGHT wing fascism these actions are the very taste of now.

This IS one of those defining moments as well as you will see again, a repeat of when the DC police add to the $25 million in fines paid for fascism they've practiced over the last 10-15 years for their obvious constitutional violations. I am sure you know by now or should, just the kind of constitutional violations the right doesn't mind at all.

The right wing in the US is quite willing to trade your freedoms...for what they 'feel' will be their safety.

What we are witness to right now, on the street, (yes, boots on the ground) is the beginning of the end of the US as a constitutional republic unless these officers are charged with contempt...found in contempt, do at least a year in jail and pay $1,000 in fines, as well as the DC police for a 15 year record of defying the constitutional rights of the people and in fact are under court order specifying all of the terms that need to be met before they can detain anybody. I say throw the interim chief in jail.

Now if the dems had gotten wise, then Obama would have thought this was possible and locked up repubs and just...leave them there. I mean after all...isn't threatening govt. shut down or not paying the debt, treason...during the repub's self-declared war on terror ? Ya'know...let the judge sort it out.

There is no question, Obama would have been a hero to many if he'd acted as radical as the right of today.

How is this "radical"

Carter and Clinton both did this same sort of thing

it's been pointed out too, that Obama also signed off on it
