that's maybe three parts hyperbole and one part observation from the forum.
You know, it's interesting -- in the infamous Schenck vs. the US case, the offending pamphlets Schenck was distributing asked merely that draftees think about what they were doing, while the most "inflammatory" rhetoric came directly from the Constitution.
Justice Holmes noted that nothing in the pamphlet suggested that the draftees should use unlawful or violent means to oppose conscription: "In form at least [the pamphlet] confined itself to peaceful measures, such as a petition for the repeal of the act" and an exhortation to exercise "your right to assert your opposition to the draft."
But the reaction of the right to this reminder of the Constitution was to deem the leaflets "a clear and present danger," which of course was neither clear nor a present danger.
Just a hysterical reaction to the words of the Constitution presented by highlighting specific sections.
