In Australia, it is illegal to discriminate on the basis of race gender and sexuality, unless there is a specific legal exemption. The most common exemption is the religious one, granted to churches to allow them to preach for example that homosexuality is sinful, which would otherwise qualify as hate speech. Affirmative action programs are activated only if there is no other basis for distinguishing between parties. So for example in a job vacancy situation, the best qualified candidate always gets the position. In the rare event of there being two candidates with precisely equal qualifications experience and suitability then affirmative action programs come into consideration and the position is allocated on that basis. It is rare for AA to be the deciding factor in these situations. These provisions are often utilised by churches to ensure that jobs are only given to adherents of that particular faith. There are some situations where discrimination can be made after an application to the relevant Anti-Discrimination Board. For example, a position of community organiser for the Aboriginal community, can be reserved for Aborigines only after a successful application. It should be stressed that the presumption is against granting the exemption, and the applicant has to prove their case convincingly. In effect, this means that approval is withheld unless the applicant can convincingly demonstrate overwhelming need. So these cases are also relatively uncommon. It is interesting that the opposition to AA programs most often comes from racists/male supremacists/homophobes etc and those who have historically opposed all measures to bring about racial/gender/sexual equality. Rm with his long and tedious history of racism, misogyny and Islamophobia is a perfect illustration of this point. It would be naive to believe for an instant that such people are interested in genuine equality - their agenda is precisely the opposite.
