Trump's transgender military ban 'not worked out yet'


The White House has not yet decided how it will implement the president's ban on transgender people serving in the US military.

Mr Trump's surprise Twitter announcement on Wednesday has been met with criticism from rights groups.

Spokeswoman Sarah Sanders said the administration would work alongside the Pentagon to decide how to proceed.

It is not yet clear how the announcement will affect current transgender service personnel.
Why was the ban introduced?

"The United States government will not accept or allow transgender individuals to serve in any capacity in the US military," Donald Trump tweeted.

"Our military must be focused on decisive and overwhelming victory and cannot be burdened with the tremendous medical costs and disruption that transgender in the military would entail."

Asked at a press briefing if troops on battlefields would be immediately sent back, White House spokeswoman Sarah Sanders said the policy had yet to be worked out.

"The decision is based on a military decision. It's not meant to be anything more than that," she said.

However, some US media outlets questioned the spending justification. The Washington Post drew attention to an analysis that the US military spends almost $42m (£32m) a year on the erectile dysfunction medication Viagra - several times the total estimated cost of transgender medical support.
Meanwhile, Politico reports that the move was prompted by threats from Republican hardliners over a spending bill which would provide funding for Mr Trump's promised military spending and border wall plans.

One Republican lawmaker had already tabled an amendment to the spending bill to prevent the military paying for transgender surgical procedures.


And there you have it and the real reason why and costs hypocrisy included. Not that anyone knew a fuking thing about the ban (and they still dont) until Comrade Draft Dodger smeared it across its shitter account. The Pentagon referred all news outlets enquiries regarding the "ban" back to the Shitehouse.

So Comrade Antichrist can just come out with bonkers statements on his shitter account and its Policy?

Justice Department Argues Landmark Civil Rights Law Doesn’t Protect Gay People
Advocacy groups swiftly condemned the DOJ filing, which landed the day President Donald Trump banned transgender people from military service.

The Department of Justice argued in a legal brief on Wednesday that the landmark Civil Rights Act of 1964 offers no protection from discrimination based on sexual orientation, a position advocacy groups condemned as “shameful” and “politically driven.”

DOJ lawyers, arguing under Attorney General Jeff Sessions, submitted an amicus brief to the U.S. Court of Appeals for the Second Circuit in which they said the department did not believe the law ― which bans discrimination based on race, color, religion, sex or national origin ― applied to lesbian and gay people. The brief was filed as part of a lawsuit filed by a now-deceased skydiving instructor, Donald Zarda, who said he was fired for his sexual orientation. His lawyers contend the dismissal violated of the act’s Title VII, which prohibits employment discrimination.

“The sole question here is whether, as a matter of law, Title VII reaches sexual orientation discrimination,” the Justice Department brief says. “It does not, as has been settled for decades. Any efforts to amend Title VII’s scope should be directed to Congress rather than the courts.” It adds: “The essential element of sex discrimination under Title VII is that employees of one sex must be treated worse than similarly situated employees of the other sex, and sexual orientation discrimination simply does not have that effect.”

Including sexual orientation in Title VII has been hazy, even under President Barack Obama, multiple outlets noted. In 2012, the Equal Employment Opportunity Commission found transgender people were covered by the provision, but there has been no clear ruling on whether gay people are afforded the same protections. (The EEOC, beginning in 2015, has said Title VII forbids discrimination based on sexual orientation, but court rulings have complicated the issue.)

The Justice Department said the EEOC doesn’t have the power to decide the issue.

“The EEOC is not speaking for the United States and its position about the scope of Title VII is entitled to no deference beyond its power to persuade,” the DOJ brief reads.

LGBTQ advocacy groups swiftly condemned the Justice Department, hours after President Donald Trump ordered that transgender people would no longer be allowed to serve in the military.

“In one fell swoop, Trump’s DOJ has provided a roadmap for dismantling years of federal protections and declared that lesbian, gay, and bisexual people may no longer be protected by landmark civil rights laws such as the Fair Housing Act, Title IX, or Title VII,” Sarah Warbelow, legal director for the Human Rights Campaign, said in a statement. “For over a decade, courts have determined that discrimination on the basis of LGBTQ status is unlawful discrimination under federal law. Today’s filing is a shameful retrenchment of an outmoded interpretation that forfeits faithful interpretation of current law to achieve a politically-driven and legally specious result.”

The American Civil Liberties Union called the DOJ position “one more gratuitous and extraordinary attack on LGBT people’s civil rights,” and said it would defend Americans’ rights in the courts.

“The Sessions-led Justice Department and the Trump administration are actively working to expose people to discrimination,” James Esseks, director of the ACLU’s LGBT and HIV Project, said in a statement. “Fortunately, courts will decide whether the Civil Rights Act protects LGBT people, not an Attorney General and a White House that are hell-bent on playing politics with people’s lives.”

A former member of Navy SEAL Team 6, the team that dispatched Osama bin Laden in Pakistan, Kirsten Beck is transgender. Beck who retired shortly before bin Laden's demise, has challenged Trump to meet her face-to-face and explain why he has reneged on his promise to the LGBT communities:

I'm really at a loss to understand why you have chosen to post this sordid tale of some creep murdering a TG woman after having sex with her and then robbing her to boot. I don't understand how this crime might be relevant to the topic.

Are you trying to insinuate that this is the 'normal' reaction of a 'red-blooded' male after having sex with a TG woman? Or are you suggesting that this crime is a sign of things to come if the military allows TG folk to enlist and serve? These are a few of the possible motives that sprang into my mind but I am sure there are other possible motives.

I'd be grateful if you could explain your thinking

The measly amount saved by the military declining to provide appropriate healthcare to its TG members ( a minuscule fraction of 1% of the healthcare budget) tells us that this move by Trump is not about money.

Trump is being true to form. He's a bully who, unable to get his way on healthcare due to his and GOP incompetence, is trying to deflect attention by picking on a tiny powerless minority. This is the kind of behaviour that gives lowlife sleazebags their unenviable reputation.

The key reason for the transgender ban is that they are disruptive to the military if they are transiting. But maybe the law should say, only a transgender who are fully done with their sex change can join.

It's kinda like with employment, employers not gonna employ women who are going to get pregnant. Try looking visibly pregnant and go for job interviews. Most people don't take you because it's disruptive, divided between a new born child and work. And of course long maternity leave in a few months time.

Here's what polls say about a transgender military ban

A poll conducted less than one month prior to President Trump's decision on Wednesday to reverse an Obama-era policy that allowed transgender individuals to serve openly in the military found more people opposed than supported it.

Rasmussen surveyed 1,000 likely voters on the topic in late June, almost exactly one year after then-Defense Secretary Ash Carter announced the shift last summer.

"The U.S. Department of Defense now allows transgender people, those who identify with and want to live as the opposite sex, to serve openly in the military," the survey said. "Is this decision good for the military, bad for the military or does it have no impact?"

Only 23 percent of people surveyed responded that it was good, while 31 percent said it was bad. The largest bloc of respondents, 38 percent, said it has no impact.

As the Washington Examiner reported earlier today, a Military Times poll conducted last December found 41 percent of active-duty troops believed the policy hurt military readiness, while only 12 percent said it helped.
