Status: offline 		While it's probably the most jack-ass decision ever rendered by the High court, it definitely doesn't speak of Socialism.

What it really is and does do, is effectively turn both unelected bureaucrats and local Government minions into an oligarchy for deep-pocketed developers and big business.

Clearly the best remedy for those that are scared by this decision, would be to work at both their state and local levels drafting legislation that would more narrowly define how their local government may apply eminent domain laws.

Also, don't purchase any property that's inside the perimeter of an urban renewal zone. HAR!

I truly believe this issue will be revisited by the court at a later date.

Status: offline 		Yes, basically I agree. I've read that the new eminent domain standards are not going to be very easy for townships to pursue in practice, but the fact that this is going to be fubar to implement obviously doesn't mean it was a good idea in the first place.

All of you are only looking at it as a capitalist or big business venture.What about my property at a lake?It could be taken for housing of different types.Low income housing from and for the community,sold to a developer for housing like condos and many other things.You all seem to be only looking at it as capitalism.You are not lookig at the whole picture.
It could also be taken and made into a park that would benifit the community.
The Supreme decision didn't state that it had to be for a business.It only stated that if the commuinty would better benifit from it.Also if someone wanted to buy a house and tear it down and build a much bigger and more expencive house then the community would benifit from this in the form of the new owner paying more taxes.
That was my lake front property that I was talking about.Now my house is real close to an exit on I95.The state could take my house and others to make a parking lot or park that would benifit the community.
As I said you are not looking at the big picture.
Some of what I said may sound unlikely but it is possible.It would depend where the property is located.

Status: offline 		I do understand why you are upset about this ruling, but keep in mind that even the majority opinion noted that it was an issue for the states and local governments to decide how to apply it. And even Justice Kennedy noted that he would not be inclined to uphold eminent domain use if the primary beneficiary were a private party rather than the community.

The great thing you have going for you, is that, a very large majority of the populace despises this ruling. Everyone from conservative church group's , non-property owners, minorities, and even socialists have spoken out vigorously against the takings clause.

My suggestion to you, would be to put a small ad in your local newspaper with a few lines noting your displeasure over this ruling. Use the ad as a solicitation to form a PAC group within your local community. Then draft an initiative that really puts the clamps on the way local bureaucrats can use eminent domain.

You could word the initiative to where it completely eliminates the power of eminent domain from seizing private property for private commercial development - I'd bet a nickel against a donut that it would pass with flying colors. It's a lot of work but it's worth it.

Yes,And I live in one of the most liberal/socialist states.The state already wants 2/3 rds of the land for a national park.The ad has already been in the paper by another person.But it is not likely to change anything.They were already doing this before it was legal.
Last week Portland Maine was voted to be in the top 10 Green friendly cities in the country.That is southern Maine.Most of the population is in southern Maine and always out votes the rest of the state in everything.Very liberal!! I live in central Maine.And the City Of Bangor is now running biodiesel fuel.It has to be trucked from Boston because their is no demand for it.Their is no hope for this state untill it caves in on it's self because of no tax revenue after most people move out of state because their is no work here.It is a welfare state.Homeless people from all over know this and come here from time to time.It was also on the news two weeks ago that Maine is more accepting of non working immigrants.You would have to see this mess that we are into in order to believe it!

Status: offline 		I kinda had a feeling the court might revisit the issue or someone would intervene. Local governments would eventually have bedlam on their hands if they started to become more bolder.

Private property is the cornerstone of freedom and individual liberty; It generates wealth and allows independence from government and corporations - I'm glad Congress stepped in on this one.

Look People........we need to strart undertanding that we cannot keep hating eachother.....I can't understand why Americans (OF ANY FREAKIN MIX) can't band together and become an AMERICAN country....why hate?? it never brought us anything but riots and hatred towards our fellow man...uuhh and woman..lol yeah we've(our government) has don't stupid things like train people to do evil things like.....lets see.......FLY OUR planes into buildings filled with innocent AMERICAN people.....can you not remember that?? have you forgotten that?? For example, some of your posts make me think: talking out your ass, sell out, dereliction, faustian bargain (except soul not traded for knowledge), racism, blow hard, unkind, ungentle/foolish/vicious, avaricious, ignorance and dumbass (excuse the redundancy and grammar errors) but enough about my impression.
