Perhaps this is all part of his master plan...Obviously the car is haunted like "Christine"....Not only did you loose your money...But the car is somehow destined to disembowel you....Look forward to seeing it all play out on Youtube.

I'd take the car and sue him. Chances are he won't show up to the trial either so you'll win by default. Even if you never collect another dime, you'll have the pleasure of knowing that he has a judgement against him that will screw his credit over for seven years.

Since you have the title and presumably the VIN #, once it is in your name you can go to the manufacturer's dealership. Most companies can cut you a key from the VIN # with appropriate proof of ownership. I had it done with a Chevy and 2 Dodge vehicles. The former cost me about $30 and the latter $20 a piece. The keys I had on these vehicles were bad replicas (think walmart) and worked sometimes but didn't fit appropriately. I had the Chevy key the next day and the Dodge keys within the hour.

I would recommend you have the car towed somewhere he wouldn't look, BTW. People get pissy over getting repo'd, and he might very well show up to destroy the car for revenge purposes. If you have a friend or relative who would let you park it with them until this blew over or the car sold that would probably be best. Oh, and don't feel guilty about taking the car. He probably planned to scam you from the day he took the money if he just up and disappeared like that.

yes he was kicked out of his folks house and he came to me as a man, ( a man that lives with his mom *snicker) and wanted the money to put a roof over his family..ie: fiance....

Yikes!

You were kind-hearted (I am thinking 'sucker') for 'helping' him there.

BTDT, though in my case and years ago it was 2K which I could ill afford.

What I did was obtain a judgement and then declare a loss for tax purposes.
Was a real lose-lose for me but at least I harassed him a lil.

Small claims might be the better way to go here, as JuliaOceana has suggested.

As for him not being your employee any more... was he fired? quit? If quit, do you think it was because of your loan?

Well, if you pay attention to the passage of time, in some states at least, a judgement is RENEWABLE.

Depends upon how pissed you are and remain (not good for you to simmer on it) about this.

My guess is that when you see the car the bit that goes suck press bang blow ,you know that lump of metal under the bonnet wont, go suck press bang blow I mean !

Never mind vehicle should have a scrap value. NO?
minus storage charge, police recovery fees , locksmith costs, tow charges....am I cheering you up ?

Have you considered getting him another job for at least a couple of months and have his employer pay you some from his salary every month? If you can do so, simply put the note with the offer under his windshield wiper. It may be that he is simply ashamed and avoids contact for that reason.

If you find it worth your time, you can ask for a continuance or refile and the judgment will be issued for another 7 years. You can do this indefinately in most states.

I don't think you'll recoup much of your money after paying various costs associated with selling the car, but that's for you to judge. I have a feeling that a man with a family, who had a job and quit it to escape from a measly $1000 loan, already has a bad enough life that very little you could do would make it any worse for him. Pity him and make $1000 to cheer yourself up and pay yourself back. The whole thing doesn't seem worth all the aggravation, IMO.

If you can find his car, why can't you find him?

Did he actually sign the title over to you, or just give to you to hold on to?

If he signed it, you need to go to your local DMV and do a title transfer before trying to take possession of the auto, otherwise it will be you going to jail for auto theft.

I don't know how $1,000.00 relates to you and your lifestyle. I've lent people money throughout my lifetime to friends, and employees. My attitude about the person disappearing and never paying it back is that the money was the cost and/or value the other person placed on the friendship or employment. In no case did I consider the money wasted.

Spending the money was, to me, better than spending and wasting emotional involvement of misplaced friendship or misplaced personal responsibility for an employee. It was money well spent. My time investment, emotions, and concerns for the well being of my friends and on another level my employees are legitimate. Knowing they aren't reciprocal is valuable information. When I lent money and didn't get it back, I moved on and appreciated the opportunity to learn how much I or my job meant to the other person.

On the pragmatic side, if you don't want to take possession of a $500 vehicle, file a lien on it. It may never pay out, but if the person ever tries to transfer title he won't be able. He may contact you and you'll have an opportunity to vent $1,000 worth of frustration.
