Every state seems to have its own take on this age of consent thing. In my state 16 is legal, 15 is not. If the age difference is also at least three years, its good for 4 years to life instead of 2 years to life. Still a felony, even if one is 15 and the other is 16. Presumably, its a felony for both if both are under 16, although its up to the prosecutor to decide whether to prosecute anyone under 18 as an adult or as a juvenile, in which case the penalty can be minimal. It is also a defense that the person reasonably believed that the "victim" was over 16. The person who took the video would have been in line for the 4-year minimum penalty, for "sexual abuse of children". So, now the kid has served two years, the law has changed, everyone but the prosecutor seems to think he should get out. We've seen pictures of the kid. He is black. Was the girl black, or white? Seems to me this is something that matters in certain places. Georgia is probably one of those places.
