It's easy to say well officer everyone else was speeding and you didn't ticket them, it is not, however, ever a valid defense for your own actions.

Please cite the laws pertinent to your position... I would be flabbergasted if you actually do.

Oh, and one more thing, if you think that making a new screen name makes one incognito so that they can flame with impunity, think again... they can track your ISP and compare it to others in their records.

I'm sure this is going to get pulled but your version of the law seems to be incredibly self-serving and not even remotely close to true.  There's no right to post anonymously when it comes to admin.  Read the contract.  There's no right to say whatever you want ever, even when it applies to the government, which here it does not.  The consideration you get from the TOS is the ability to post here and free despite the fact that there is a monetary value in the industry for the service.  There are plenty of cases on internet contracts that are very similar that have found them to be quite valid.  Again, it's not a conspiracy, get over it but stop misstating the law to be something you want it to be.  That's not it.

The poster I responded to is saying "the law" as it applies to contract law and the right of free speech in the United States and claiming it is their right legally.  He/she is not referring to CM "law" that I can tell and in fact that on the issue of free speech where there is no government action, they can in fact suppress your statements or refuse to allow you to speak, even in the arena of govenmental action and free speech you cannot speak unlimited.  That was my point, not CM's "law" as that is merely a matter of contract and stated rules enforcing that contract.

However, your point does have merit NG as the rights one has on this site come from that contract http://www.collarme.com/tos.asp and for the most part not the First Amendment for American posters at least (maybe even all as I seem to recall the TOS sets jurisdiction for disputes as being in the US).

I disagree. You agree to live by house rules, and house rules dictate that you can say whatever you want, but unacceptable posts will be dealt with accordingly.

What opened my eyes in the Terms of Service was how many times the $50,000 was used...I wonder if there has ever been a judgment for money because of a paragraph or two in a TOS?

That is to cover third party damages, if you are responsible for someone making claims against the site, it just says the site can claim those damages from you. Another reason that when people click the yes button to say you have read the agreement they should actually read it. The people that don’t know what is at stake are the irresponsible ones that haven’t and so think the rules are only there to ruin peoples fun. The site isn’t going to be out of pocket if someone makes a ridiculous claim against it, you are.
