You are talking about the Civil Rights Act of 1964.  NOT the constitution. 

No,he means the 14th ammendment. Specifically how the SCOTUS interpreted the ammendment in Brown V Topeka and subsequent rulings. The 14th requires equal protection under the law and that means laws cannot exclude certain classes of people from public accomodations definitely including restaurants.

14th amendment states that all laws must apply to all equally. You cant single out a certain group of people.

Say if oh,...I dunno,...Ted Kennedy was in a bar and had his usual 30 drinks and the barman "turned him off" that wouldn't be "discrimination would it?

 Miss.State Department of Health criteria for obese persons:

1. If you look down and can`t see your feet,no service.

2. If your belly touches the counter,no service.

3. If you can`t get chicks,no service.

4. If there are parts of your body that you can`t reach or wash,no service.

5.If you shop the "Big and Tall" dept,and aren`t tall,no service.

6.If " super-size" is your nic,no service.

Of course there`ll be a government training course to identify the obese,which will be required before receiving a state license.

I think this will go the way of DLs for illegals.

What is often missed in attempts to treat the Constitution as Scripture, is that buzzwords are only relevant in the context of 'reasonableness'. 

'Reasonable' as in a person who is trained to apply the rules of logic and arrives at a reasoned conclusion, not 'reasonable' in the current sense of 'close enough'.

There are reasonable grounds for keeping a person out of one's restaurant, and there are cases where such a ban would be patently unreasonable, and would therefor violate the Constitution as it is applied in real life.

This has to be the stupidest law I've ever heard of actually being proposed.

I mean, seriously, what's even the point of it?  To help heavy people lose weight by forcing them to cook their own foods?  To force fat people to have someone else pick up MccyD's for them?  To piss off the heavy people who they're proposing the law to as some sort of passive aggressive stab?

If it's not just some stupid stab at a fat person in their legislator or just a way to get attention, how did they even expect it to be enforced?  Were people to stand on scales, or were they to be judged by the eyeball?  Or..

Gah.  If only there were a law against proposing really stupid laws.

You can throw anyboy out or even refuse service to anybody as long as you do it for reasons specific to that individual. Once you're refusing to serve any Irish or any fat people you've violated one of the Civil Rights acts. If a state or local government passes a law that is equivalent to banning some identifiable class from some sort of public accomodation that's a violation of the 14th ammendment.

To Gwynvyd, the far right knows the various and sundry state and federal laws banning gay marriage are violations of equal protection and eventually someone is going to get a good legally sound challenge to one up to the SCOTUS and that would be the end of that even with the present make up of the court. However a constitutional ammendment banning gay marriage would trump equal protection which is why the want the ammendment so bad.

Yup.First the "war" was on smoking now the "war" is on fat people and pushing healthy eating and lifestyle,. It'll never end once you wipe out smoking in public and in your own home and cars and in general and once you make all these rules against fat people and get that acomplished, they'll look around and say what can we target next?

I feel if you're so large you take up two seats you should have to pay for two seats. Weather it's on an airline or a bus or a train.

Are they going to ban stupidity anytime soon? Because if they do there won't be many of our law makers walking around free anymore. And how will they determine who is "fat" and who is just a little chubby? when do they start building special "camps" for fat people, gays/lesbians, sexual deviants and anyone who doesn't fit into their "norm". 
There is a country in Europe called Germany who in their past passed laws kind of like this one only the people targeted were called "Juden". Learn from the past or you are bound to repeat it.

Holy shit we were just bitching about this yesterday!

They are now cutting back on lunches in our school system and doing more "Portion Control" because they fear helping with childhood obesity.

My son who is a twig eats everything not nailed down well enough. He comes home *starving* every day from school since the change.

What I am wondering is what about the poor kids who's only decent meal might be the free one they get at school?   What the hell where these doinks thinking?

Why not add gym class every day of the week, or healthier meals? Why take food out of thier mouths??? *Literialy!*

That new rule is being considered in my school district, but the reason behind the obesity excuse is waste/cost. School lunches are more expensive to prepare now that they have to offer more fresh fruits and vegetables, and healthier choices in general.
It is a fact that a large percentage of the food prepared and served ends up in the trash. Kids eat what they want, toss the rest. Some children do eat everything. Most do not. It is easy to spot the children who aren't being fed well at home because they eay everything every day.. quickly.

You're right to mention school lunches: what shocks me is how quickly the children are expected to eat (my son has a 1/2 hour lunch break). If longer lunch breaks were promoted, children would be encouraged to take their time while eating, instead of being effectively forced to wolf their food down.

Also, I don't understand why schools provide children with a choice of lunches. Aside from particular dietary requirements (if a child has diabetes, or what have you), why aren't young children given one nutrionally sound lunch (same for all)? Frankly, having to choose between pizza of chicken nuggets is a joke. It should be part of their education that they learn how to sit down at a table and eat civilised food in a civilised way - though the responsibility for this resides mostly at home. And don't get me started on the children who are given a peanut butter and jelly sandwich for their packed lunch: what's up with that?!!!

There's a lot to do to fight obesity today, and it starts with giving children no choice but to eat healthy food.
