I'm going with guilty of manslaughter. Of course I don't see how she did it. As someone who swims in the ocean frequently, ummm saltwater sorta burns your eyes and does things to your throat and stomach after you've swallowed even just a little bit *cough cough - chest hurt gosh I need to go on the sand kind of thing* So giving a bj, waves rolling in, saltwater burning and an intoxicated however slightly man holding on to one's head...hmmmmmmmmmmmm calls *Mythbusters* I don't buy it. changes My verdict to Guilty of murder.

Although personally i think its probably a horrible accident i am going to say that he should be tried for murder.
The only tangible evidence is that a man took his wife out to sea,she drowned and there are marks of a struggle taking place by the scratches on his legs.
Set everything  else aside as heresay and the testimony of the possible killer (the underwater blow job,past experiences of mild breath play etc) and the evidence would at least make a guilty of murder verdict possible.

Its a shame the worlds not ready for kink aware/friendly juries yet!

I would be currious to know what those scratches looked like.

It's a sad case.  I hate when people do something in the name of fun and someone ends up getting hurt or killed.  This does happen though.  If someone is doing something that contributed to someones death then they are guilty.  That is, if the person were not doing whatever action then the other party would be alive.  I think this one hits home because of the subject.  It's not any different than people drinking and driving at high speeds with people riding on the side of a pick-up truck bed.  It is risk and everyone sees it as such.  The driver would be guilty if he bounced someone out and they were killed.  There would be no excuse for "we do this all of the time and nobody ever died before."
