Actually, he was forcing a point to cause trouble.  He should be sitting in jail for interfering with law enforcement in the performance of their duties.  That is a crime.  He came up with an antagonistic attitude trying to ignore what he was asked to do at a legal checkpoint.   He was neither within his rights or even thinking about what is right.  There is no constitutional right to be a beligerant asshat to men performing their duty.
Since there are so many "nonracists" out there who will stop after passing through border checkpoints to pick up illegals who have snuck around them, these checkpoints have a valid reason for their existence.

Yea it's great that the person is aware of his rights yet all I saw was an arrogant idiot being deliberately rude and antagonistic towards the Border Patrol. Like what Irishknight stated, the driver was ignoring the requests which in turn is a refusal to comply to a request. Frankly I think the gut is in bad need of an attitude adjustment.

He set this camera up beforehand. He was aggressive from the start. He was obviously spoiling for a fight. The US supreme court has upheld the border aptrols rights to do internal checks.
This idiot was obviously trying to prove some sort of point. I agree with GT. I'd have busted out his window and sprayed his ass lmao. Oh and btw when a LEO asks you a question answer it. You are obviously trying to hide something if you act like this.

Edited to add that the damn reason to suspect was him acting like that. You act like that to me on the road and it's going to throw up all kinds of red flags.

Amazingly, in an earlier false claim, he stated that border patrol agents pulled him out of his car and beat him.  Methinks he forced this confrontation to try to make that a reality.  Quite honestly, this guy gave them plenty of reason to arrest him and should be in jail.  I don't see where the problem is with the actions of these border patrol agents.

And did anyone see nunchakus?  I saw something but it moved to fast.  I would guess it was an asp extendable baton.  Those are commonly used to break out car windows when you need to extract someone.  If it was a pair of "nunchuks" as the asshat asserted, then this film is a staged fake filmed at one of the many abandoned weigh stations beside our highways.  I have known many law enforcement officers including border patrol agents in my life and I am relatively certain that those weapons are on the list of weapons not allowed for carry while on duty.

This is a good write up of the fourth amendment right as it pertains to road blocks and this man was causing a problem not defending his right because according to sepreme court decisions while at the check point they had every right to stop him and ask him questions read the WHOLE section under road blocks and specifically the part about stoping cars at a boarder check point for illegal aliens.

Seriously this guy was not the Hero you are painting him to be.

Steel I don't see myself as painting anyone a hero......just don't appreciate small minded men in uniform who beleive...."because I want to" is valid justification for search and detention.
I've been in that situation ,with state troopers .Stopped for speeding and putting up with the indignity of having my car searched...why because at the time I wore my hair long.For the life of me I wish the answer to "do you mind if I search your car" would've been ...hell yes I mind,write me the ticket and I'll be on my way...but I was young and foolish and intimidated by the uniform.
Forget the border aspect...make it a Trooper...the result is often the same,on some spurious suspicion they request a search,how many of us figure what the hell I have nothing to hide and allow it?

No Mike. Of course we have the right to ask why.

But he knew why! He knew why because he set it up to happen, and I'd be willing to be that he wanted things to go further than they did.

He orchestrated the situation. It was obvious to most of us who watched the video and I would assume (yes, assuming again) that they border patrol was very aware of that as well.

If he didn't have the camera and still acted that way, I would expect him to be detained because of his blatantly aggressive behavior.

I was involved in Meth as a Kid and with Trafficing however I was never caught in posession, because of this there is a Note on the NCIC under me that says Suspected Drug Trafficer.

Now I know that I had done something wrong but there was absolutely NO proof against me that could support the claim.

To this day if I am pulled over by Highway Patrol, A State Trooper, or a Regular old officer, I know that I will eventually be asked to exit my vehicle and it will be searched. usually with me sitting back on a side walk or standing by the hood of their vehicle.

In the event that I say "No, you cannot search my Vehicle" Some cop will say I think I smell marijuana and have reasonable suspision to search your vehicle. now I will be told I am not being arrested but being put in handcuffs as a safety precaution to make the option of running away less desirable.

Is this "Wrong" sure but it is something that I have to live with. After complaining one or two times and having it get even worse I learned that because of the fact that OTHER PEOPLE do stupid shit these annoyances have become necessary and as such a Necessary Evil.

I say this guy needs to stop provoking people who are doing a job and just learn to be patient and be an upstanding citizen who may know thier rights but also knows how to conduct themselves with a proper attitude and demeanor.

Who says we still are, or ever were? the Fourth Amendment has been altered so many times that only your Home is free of that and if you are a Suspected Terrorist then you aren't safe even there. The 4th actually says you are free of Illegal Search and Seizure, they way they do it now it is Legal so your 4th is stil protected.

Understand that your rights are being altered by the actions of your countrymen this is how the constitution was designed so you kinda gotta keep up to date on exactly what the constitution actually means because what it was in 1776 isn't the same document in 2009 so you kinda gotta keep up.

Sadly you are an individual have the right and responsibility to be a part of those decisions by voting in your representative who will represent you to conress and the supreme court sadly we are not always as interested in who we ellect into those offices as we are who we elect into the main seat.

The Fourth Amendment Right is in my opinion the Most Changed and Misused Amendment there is, because under the questionable wording it can be turned into many different things.

Just like Freedom of Speech, and people telling a Network that they HAVE to air someone saying their peace. Freedom of Speech is afforded to the Owner or Board of Directors of that Network No one has a right to say what they broadcast. Freedom of Press is afforded to the Owner or board of directors of that Paper. Most people think that if they say something it MUST be Heard when in reality only those who are able to be heard will be heard and now that we work on a Global setting it is harder and harder for the single man to be heard unless he has big guns behind him..... and sadly it was by using the rights we are fighting for that the rights became what they are today. when things got changed someone somewhere was vendicated and someone somewhere else had the way things used to be changed.

I do not see it as Illegal Search and Seizure. I see it as LEGAL search and Seziure because the way they are doing it now is completely legal under the terms they offer.

Even though Steel I fall inot the catagory of those that the changes help I have to agree with you here. Yes is my job made much easier by the changes in the laws yes. That being said I don't quite agree with how much they have changed. I am one that thinks the constitution is what it is, but our forfathers didn't see the challenges we face today.
