I'm a bit confused. So this guy is at a checkpoint, sounding very aggressive and antagonistic. Then he is surprised that he gets detained?
Don't people get detained when they display certain behavior?

I'm not being sarcastic. It seems like he (camera guy) is setting this up for the purpose of taping.

This is about someone forcing a point to make a point.

What really sucks is that people who have no idea what it is like getting through a Border Checkpoint think this is what it is like and should they ever have to are preparing for a Problem.

It's Retarded.

I'm all about protecting your rights but When you Leave America and then Return to America until you are on AMERICAN SOIL you are afforded NONE of your Rights. This man could have been shot and killed because of how he was acting.

I learned this lesson while in Tijuana, if you are stopped by anyone claiming to be a Federale YOU DO WHAT THEY SAY, because if they aren't real then they are criminals and could kill you, if that are real then you most likely have done something very wrong or are suspected of doing something very wrong and you want to be as helpful and polite as possible in order to continue on your way.

This kinda thing annoys me to no end.

Not my take on this at all....Should be mandatory viewing for all H.S. students as well as LEO's.The mere assertion of ones rights is not and never has been grounds for suspicion.

Steel this was an internal checkpoint...he never left the U.S...therefore he wasn't trying to reenter the U.S.
To me the whole episode comes down to the Officer explaining that his assertions of his rights were in fact suspicious....BULLSHIT.Apparently higher authority decided the motorist was right....no 'reasonable suspicion" ..no search.

It was what is called an internal checkpoint.The Supreme Court has upheld their right to set up within one hundred miles of a border.Sort of like a sobriety checkpoint for illegal aliens.
But these guys were overstepping their authority,this man gave them no reason to suspect he wasn't a citizen and his asserting his right to remain safe in his person is not grounds for suspicion....certainly didn't give these clowns in uniform the right to detain him.

Yep, I know of 2 internal checkpoints near San Diego.  One's on I-5 near Camp Pendleton and the other's up on I-15 above Escondido or so.

See what happens when you put Americans in a uniform and give them a border to protect? The guy's whole argument could be summed up in one word - sovereignty, something which is to be respected at any border. The United States is territorial, and that territory is never arbitrary. That's the whole point of having a border in the first place.

The border agents are not very smart people. It is obvious from the start  the guy is not a violator of anything. Why not just let him go? After all,  he is one of thousand who wold not accept their inspection.

personally, I'd have busted out his window then given him more stitches. AND smash the shit outta his camera.  He pulled into the checkpoint with a camera running.. he INTENDED to incite the LEOs.

I've been through that checkpoint many times..  Normally, theyre pretty laidback, unless given cause to NOT be.

The patrol stops every vehicle and asks a few simple questions, and lets you proceed. It's obvious that the dickhead in the video was antagonistic and uncooperative.

He's got balls, and he knows his rights. I don't know the guy (I've heard him accused of being racist, and also a pastor... shudder) but as a citizen that knows his rights and exercises him, he is a fine specimen.

And yes, this is the guy who was beaten to a pulp a few days ago. Too bad he didn't have his camera with him that time!

Anyone ever been to California Via the 95?

I ask this because there is a checkpoint that asks if you have any Fruit to declare.

It is a MANDATORY stop. If you drive through without talking to the people the Highway Partrol will Pull you over and give you a Ticket for Failure to Stop for Vehicle Inspection.

I don't think anyone freaks out at these.

The more I read about these things the more I dislike this guy and go back to my original view. Apparently it is a simple check point that will determine if you are suspected of harboring border jumpers which gives the checkpoint time to view and access the actual possibility if you are Harboring Aliens in your vehicle, which IS a crime and IS a Problem. By doing what this guy is doing it is easier to assume that he actually IS Harboring Aliens and is refusing search to keep them from being found (All Hypothetical situations)

I now go back to my Original thought that this is someone who is forcing an issue to make a point.

I have not seen enough misbehavior to decide if the Border Patrol is consistantly making miscomments and thus infinging on peoples actual rights.

I do know that these Check Points do have contact with Highway Patrol, and that should you be suspicious you should expect to be pulled over shortly after stopping at one. Because where as Stating your rights is not a reason for suspicion, failure to be cooaperative sure is. Ask any cop who is breaking up a disturbance and they will tell you as they hand cuff you and depending on how rowdy you get can even arrest you for disturbing the peace, or my favorite General Misconduct or Mayhem. That one gets you a night in holding before you get released.

I can respect that the guy is making it a point by fighting for his rights and knowing them however it all gets thrown out the window when he makes it a point to be uncooporative.

One can be right without being a Douche.

Say you are at an airport about to go through security. If you acted like *camera guy* you would be pulled out of the line and checked.

Aren't those who perform such checks trained to observe and notice those people who are acting in an unusual fashion? Isn't it their job?

I think *camera guy* knew exactly what he was doing and he elicited the precise end he was seeking. Or he would not have had the camera running.

In no way was he acting normal. He was seeking attention and got it.
