I think that prostitution is usually defined as money exchanged for actual sex. Sex work seems to cover all exchanges of money for sexual acts, which may or may not include sex. So a sub receiving money for just a spanking would be a sex worker, but not a prostitute by most people's definitions.

The following is an example of a New Mexico statute defining prostitution:

"Prostitution consists of knowingly engaging in or offering to engage in a sexual act for hire. As used in this section "sexual act" means sexual intercourse, cunnilingus, fellatio, masturbation of another, anal intercourse or the causing of penetration to any extent and with any object of the genital or anal opening of another, whether or not there is any emission. Whoever commits prostitution is guilty of a petty misdemeanor, unless such crime is a second or subsequent conviction, in which case such person is guilty of a misdemeanor."

I guess, at this point, it would depend on where you live and what you do.. for pay.

Are we concerned here with the law, or with personal opinion? In the example given in the OP, yes, that is going to be considered prostitution under the law in any state in the US that I am aware of. There are a few jurisdictions such as some counties in Nevada where it would be legal however.

Every state has a different definition of what constitutes prostitution. Some states, such as Arizona, even include bondage and fetish costumes and flagellation as sexual activities that constitute prostitution if done for money or valuable consideration, or promise of same.

Personal opinion, there should be no laws on prostitution or other victimless crimes such as drug use or possession out of some mission of moral superiority. No victim = no crime.

Most states require penetration of some sort for it to be prostitution... odd that huh.

Again, i wonder at people who can be so judgemental as to lable what others do a crime, yet, sit back and twirl that flogger, snap that whip, slide the handcuffs away, and claim its all in "good fun".

OP.. again... why the concern? why does it matter? there isnt a single one of us here who have not commited a sex crime of some sort, in some fashion, including yourself.

I wanted to bring this out of the rest and point something out, OP. Just because a submissive is pro, or a Domme is pro, doesnt mean the genitals are in "use". Orgasm control doesnt mean mine have to be touched, im voice trained. And, god, if enemas are now part of prostitution, the medical profession best give up that nasty little task.

Por Dommes are legal in some places. It would depend on the contract between the two. Like with any contract, once the commitment of said contract is fullfilled, the two parties are free of its obligations. Money paid, services rendered... all is good.. end of contract... now lets fuck.

No prostitution.

If, in your own mind, you require material compensation (whether that's a shopping trip, fine dining, cold hard cash, your rent being paid, gas for your car, etc.) in order to provide or receive sexual favors, or imply that you may provide sexual favors if you get these things, yes, you're a prostitute. Whether you get caught at it is another question. Some prostitutes are more subtle in their craft than others.

For a prostitute, sexual activity is a means to an end, regardless of whether he or she happens to enjoy the means or not. For a slut, on the other hand, the sexual activity itself is the goal, and they go about gaining materially in other ways. I think that some folks just have a natural tendency to prostitution. I'm sure it's been going on since it was one of several different social strategies to get fed after a successful hunt.
