You're right; I looked up the relevant code section, and the Oil Pollution Act of 1990 does NOT preempt state law.

That said, preemption is complicated, and I do love to talk about it. If you can educate me, I'm glad to listen. And on this board I could care less that you're a sub; as long as you're sharp and willing to get specific.

Yeah I know. The effect, however is the same. Those EPA fines go per day and they will totally shut them down for operating in violation of the regulations. By the time someone actually makes it to court, the money is all but gone, but saying hey the EPA already slapped me hard, is NOT a defense, believe me. Been there, done that, have the ruling against the argument to prove it.

You should probably go check the act; it is in fact a cap. That means they don't keep fining BP until they are shut down. They fine them until they hit the cap.

You have some misconception that doing anything that far under the water is a controlled environment.

Nope, I do not. Making a movie, where there isn't gallons of oil spilling onto your " set " < your set meaning underwater> and where you can abandon your scene if things go awry is controlled. You seem to be assuming that conferring with Cameron and checking out Costner's technology comes at the expense of seeking expertise elsewhere. Do you have any evidence that that is the case? The NY Post article to which you linked mentioned that the administration was also talking with "elite scientists," which strikes me as entirely appropriate.

I honestly can't tell why you're so worked up over this. Or it is just a chance to score some points off Obama?

So why don't you name everyone in the world who is an expert on millions of gallons of oil spilling into the gulf.  THERE ARE NO EXPERTS ON SOMETHING OF THIS NATURE.

Then maybe they should at least TRY  the ones James Cameron designed. If what they are using now is not working it makes sense to try something else doesn't it?

BP IS SUPPOSED TO CLEAN UP THE MESS THEY MADE!  that's what they are supposed to do about the leak. Obama did not cause this BP CAUSED THIS. ITS THEIR RESPONSIBILITY. All Obama should do is put a foot in their asses.

Dude, no offense, but BP has a market capitalization of well over 100 billion, even now after the spill. I wouldn't be surprised if Goldman bought and sold about $250million in BP most days.
