They said there was not enough evidence to even warrant an investigation. It seems it is not enough that all the black women paid less than all the white women. I would need proof that "the proximate cause of the pay differential was solely based upon race." (their language) This means that if they were paid more because of nepotism, there was no legal cause of action. Nepotism is frowned upon but not illegal. The law only protects against unfair employment practices in regards to race, color, religion, sex or national origin. If the complay contends that they got paid more because the boss thought they were cuter, taller, smarter, or or he just liked the way they smelled; there is no cause of action and the EEOC won't even look at it. That's why this type of racism goes on so much. It is very very difficult to prove because you have to prove what was in someone's heart and mind, not just their actions.
